Legislative Audit Committee. The bill allows the Colorado state
fair authority (authority) to collaborate with a state agency to develop an
industry display at the Colorado state fair and industrial exposition. The
bill also:
! Clarifies that the authority may receive information related
to an industry display from an industry representative;

Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, 35-65-105, amend2
(1) as follows:3
35-65-105.  State fair and industrial exposition. (1) (a)  There4
is hereby established the Colorado state fair and industrial exposition,5
which shall be held annually at Pueblo, Colorado, for the display of6
livestock and agricultural, horticultural, industrial, mining, water7
conservation, tourist industry, recreational, educational, and scientific8
facilities, processes, and products of the state of Colorado. A

COLLABORATE WITH A STATE AGENCY OR AN AFFILIATE OR EMPLOYEE OF13
A STATE AGENCY ON DEVELOPING AN INDUSTRY DISPLAY OR TO OBTAIN14
INDUSTRY INFORMATION AND TECHNICAL ASSISTANCE FOR THE INDUSTRY15
DISPLAY.16

HE AUTHORITY MAY RECEIVE INFORMATION FROM A17
REPRESENTATIVE OF AN INDUSTRY DESCRIBED IN SUBSECTION (1)(a) OF18
THIS SECTION FOR THE PURPOSE OF DEVELOPING AN INDUSTRY DISPLAY .19

HE BOARD SHALL ESTABLISH A PROCESS FOR APPROVING THE20
INDUSTRY DISPLAYS TO ENSURE THAT THE COLORADO STATE FAIR AND21
INDUSTRIAL EXPOSITION DISPLAYS INFORMATION THAT CONFORMS WITH22
SUBSECTION (1)(a) OF THIS SECTION AND IS APPROPRIATE FOR PATRONS OF23

SECTION 2. In Colorado Revised Statutes, 35-65-401, repeal2
(9)(c) as follows:3
35-65-401.  Colorado state fair authority - creation - board -4
powers and duties. (9)  The board shall:5
(c)  Hire and employ the manager of the Colorado state fair6
authority in accordance with the provisions of section 35-65-403;7
SECTION 3. In Colorado Revised Statutes, 35-65-403, amend8
(1) as follows:9
35-65-403.  Office of manager of the Colorado state fair10
authority - creation. (1)  The office of manager of the Colorado state fair11
authority is hereby created. The board COMMISSIONER OF AGRICULTURE ,12
IN CONSULTATION WITH THE BOARD, shall appoint AND EMPLOY a manager13
of the Colorado state fair authority. who shall THE PERSON APPOINTED14
AND EMPLOYED AS THE MANAGER MUST have knowledge of livestock,15
agriculture, horticulture, industry, recreation, education, and scientific16
facilities, processes, and products of the state of Colorado and who shall17
MUST have experience in fair management and promotion. The manager18
shall serve for an indefinite term, and shall MUST not hold any other19
public office, but shall AND MUST devote his or her THE MANAGER'S entire20
time to the service of the state in the discharge of his or her THE21
MANAGER'S official duties. The appointment or removal of the manager22
shall be IS subject to the provisions of section 13 of article XII of the state23
constitution and the statutes enacted pursuant thereto TO THAT SECTION.24
Notwithstanding any law to the contrary, the office of manager of the25
Colorado state fair authority shall be IS a position in the senior executive26
service for purposes of section 24-50-104 (5)(c). C.R.S.27

-3- SECTION 4. Act subject to petition - effective date -1
applicability. (1)  This act takes effect at 12:01 a.m. on the day following2
the expiration of the ninety-day period after final adjournment of the3
general assembly; except that, if a referendum petition is filed pursuant4
to section 1 (3) of article V of the state constitution against this act or an5
item, section, or part of this act within such period, then the act, item,6
section, or part will not take effect unless approved by the people at the7
general election to be held in November 2022 and, in such case, will take8
effect on the date of the official declaration of the vote thereon by the9
governor.10
(2)  Section 3 of this act applies to the appointment of any manager11
of the Colorado state fair authority on or after the effective date of this12
act.13
