10		-	Be it enacted by the General Assembly of the State of Colorado:
11		-	SECTION 1. In Colorado Revised Statutes, 35-65-105, amend (1)
12		-	as follows:
13		-	35-65-105. State fair and industrial exposition. (1) (a) There is
14		-	hereby established the Colorado state fair and industrial exposition, which
15		-	shall be held annually at Pueblo, Colorado, for the display of livestock and
16		-	agricultural, horticultural, industrial, mining, water conservation, tourist
17		-	industry, recreational, educational, and scientific facilities, processes, and
18		-	products of the state of Colorado. A
19		-	DISPLAY DESCRIBED IN THIS
20		-	SUBSECTION
21		-	(1)(a) IS REFERRED TO IN THIS SUBSECTION (1) AS AN
22		-	"INDUSTRY DISPLAY".

50		-	INDUSTRIAL EXPOSITION DISPLAYS INFORMATION THAT CONFORMS WITH
51		-	SUBSECTION
52		-	(1)(a) OF THIS SECTION AND IS APPROPRIATE FOR PATRONS OF
53		-	ALL AGES

55		-	SECTION 2. In Colorado Revised Statutes, 35-65-401, repeal
56		-	(9)(c) as follows:
57		-	35-65-401. Colorado state fair authority - creation - board -
58		-	powers and duties. (9) The board shall:
59		-	(c) Hire and employ the manager of the Colorado state fair authority
60		-	in accordance with the provisions of section 35-65-403;
61		-	SECTION 3. In Colorado Revised Statutes, 35-65-403, amend (1)
62		-	as follows:
63		-	35-65-403. Office of manager of the Colorado state fair
64		-	authority - creation. (1) The office of manager of the Colorado state fair
65		-	authority is hereby created. The board COMMISSIONER OF AGRICULTURE , IN
66		-	CONSULTATION WITH THE BOARD
67		-	, shall appoint AND EMPLOY a manager of
68		-	the Colorado state fair authority. who shall
69		-	THE PERSON APPOINTED AND
70		-	EMPLOYED AS THE MANAGER MUST
71		-	have knowledge of livestock,
72		-	agriculture, horticulture, industry, recreation, education, and scientific
73		-	facilities, processes, and products of the state of Colorado and who shall
74		-	MUST have experience in fair management and promotion. The manager
75		-	shall serve for an indefinite term, and shall MUST not hold any other public
76		-	PAGE 2-HOUSE BILL 22-1022 office, but shall AND MUST devote his or her THE MANAGER'S entire time to
77		-	the service of the state in the discharge of his or her THE MANAGER'S official
78		-	duties. The appointment or removal of the manager shall be IS subject to the
79		-	provisions of section 13 of article XII of the state constitution and the
80		-	statutes enacted pursuant thereto TO THAT SECTION. Notwithstanding any
81		-	law to the contrary, the office of manager of the Colorado state fair
82		-	authority shall be
83		-	IS a position in the senior executive service for purposes
84		-	of section 24-50-104 (5)(c). C.R.S.
85		-	SECTION 4. Act subject to petition - effective date -
86		-	applicability. (1) This act takes effect at 12:01 a.m. on the day following
87		-	the expiration of the ninety-day period after final adjournment of the
88		-	general assembly; except that, if a referendum petition is filed pursuant to
89		-	section 1 (3) of article V of the state constitution against this act or an item,
90		-	section, or part of this act within such period, then the act, item, section, or
91		-	part will not take effect unless approved by the people at the general
92		-	election to be held in November 2022 and, in such case, will take effect on
93		-	the date of the official declaration of the vote thereon by the governor.

95		-	of the Colorado state fair authority on or after the effective date of this act.
