ONCERNING MODIFICATIONS TO THE ADMINISTRATION OF THE COLORADO
STATE FAIR AND INDUSTRIAL EXPOSITION
.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. In Colorado Revised Statutes, 35-65-105, amend (1)
as follows:
35-65-105.  State fair and industrial exposition. (1) (a)  There is
hereby established the Colorado state fair and industrial exposition, which
shall be held annually at Pueblo, Colorado, for the display of livestock and
agricultural, horticultural, industrial, mining, water conservation, tourist
industry, recreational, educational, and scientific facilities, processes, and
products of the state of Colorado. A

 (1)(a) IS REFERRED TO IN THIS SUBSECTION (1) AS AN
"INDUSTRY DISPLAY".
NOTE:  This bill has been prepared for the signatures of the appropriate legislative

TATE AGENCIES ARE ENCOURAGED TO COLLABORATE WITH THE AUTHORITY
IN THE DEVELOPMENT OF INDUSTRY DISPLAYS FOR INDUSTRIES IN WHICH
THEY HAVE EXPERTISE

(c)  T
HE AUTHORITY MAY RECEIVE INFORMATION FROM A
REPRESENTATIVE OF AN INDUSTRY DESCRIBED IN SUBSECTION
 (1)(a) OF THIS
SECTION FOR THE PURPOSE OF DEVELOPING AN INDUSTRY DISPLAY

(d)  T
HE BOARD SHALL ESTABLISH A PROCESS FOR APPROVING THE
INDUSTRY DISPLAYS TO ENSURE THAT THE 
COLORADO STATE FAIR AND
INDUSTRIAL EXPOSITION DISPLAYS INFORMATION THAT CONFORMS WITH
SUBSECTION
 (1)(a) OF THIS SECTION AND IS APPROPRIATE FOR PATRONS OF
ALL AGES
.
SECTION 2. In Colorado Revised Statutes, 35-65-401, repeal
(9)(c) as follows:
35-65-401.  Colorado state fair authority - creation - board -
powers and duties. (9)  The board shall:
(c)  Hire and employ the manager of the Colorado state fair authority
in accordance with the provisions of section 35-65-403;
SECTION 3. In Colorado Revised Statutes, 35-65-403, amend (1)
as follows:
35-65-403.  Office of manager of the Colorado state fair
authority - creation. (1)  The office of manager of the Colorado state fair
authority is hereby created. The board COMMISSIONER OF AGRICULTURE , IN
CONSULTATION WITH THE BOARD
, shall appoint AND EMPLOY a manager of
the Colorado state fair authority. who shall
 THE PERSON APPOINTED AND
EMPLOYED AS THE MANAGER MUST
 have knowledge of livestock,
agriculture, horticulture, industry, recreation, education, and scientific
facilities, processes, and products of the state of Colorado and who shall
MUST have experience in fair management and promotion. The manager
shall serve for an indefinite term, and shall MUST not hold any other public

the service of the state in the discharge of his or her THE MANAGER'S official
duties. The appointment or removal of the manager shall be IS subject to the
provisions of section 13 of article XII of the state constitution and the
statutes enacted pursuant thereto TO THAT SECTION. Notwithstanding any
law to the contrary, the office of manager of the Colorado state fair
authority shall be
 IS a position in the senior executive service for purposes
of section 24-50-104 (5)(c). C.R.S.
SECTION 4. Act subject to petition - effective date -
applicability. (1)  This act takes effect at 12:01 a.m. on the day following
the expiration of the ninety-day period after final adjournment of the
general assembly; except that, if a referendum petition is filed pursuant to
section 1 (3) of article V of the state constitution against this act or an item,
section, or part of this act within such period, then the act, item, section, or
part will not take effect unless approved by the people at the general
election to be held in November 2022 and, in such case, will take effect on
the date of the official declaration of the vote thereon by the governor.

of the Colorado state fair authority on or after the effective date of this act.
