Clarifies that the hiring authority of the manager of the Colorado state fair authority is the commissioner of agriculture. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 35-65-105, amend2 (1) as follows:3 35-65-105. State fair and industrial exposition. (1) (a) There4 is hereby established the Colorado state fair and industrial exposition,5 which shall be held annually at Pueblo, Colorado, for the display of6 livestock and agricultural, horticultural, industrial, mining, water7 conservation, tourist industry, recreational, educational, and scientific8 facilities, processes, and products of the state of Colorado. A DISPLAY9 DESCRIBED IN THIS SUBSECTION (1)(a) IS REFERRED TO IN THIS SUBSECTION10 (1) AS AN "INDUSTRY DISPLAY".11 (b) T O THE EXTENT NECESSARY , THE AUTHORITY MAY12 COLLABORATE WITH A STATE AGENCY OR AN AFFILIATE OR EMPLOYEE OF13 A STATE AGENCY ON DEVELOPING AN INDUSTRY DISPLAY OR TO OBTAIN14 INDUSTRY INFORMATION AND TECHNICAL ASSISTANCE FOR THE INDUSTRY15 DISPLAY. STATE AGENCIES ARE ENCOURAGED TO COLLABORATE WITH THE16 AUTHORITY IN THE DEVELOPMENT OF INDUSTRY DISPLAYS FOR INDUSTRIES17 IN WHICH THEY HAVE EXPERTISE.18 (c) T HE AUTHORITY MAY RECEIVE INFORMATION FROM A19 REPRESENTATIVE OF AN INDUSTRY DESCRIBED IN SUBSECTION (1)(a) OF20 THIS SECTION FOR THE PURPOSE OF DEVELOPING AN INDUSTRY DISPLAY .21 (d) T HE BOARD SHALL ESTABLISH A PROCESS FOR APPROVING THE22 INDUSTRY DISPLAYS TO ENSURE THAT THE COLORADO STATE FAIR AND23 1022-2- INDUSTRIAL EXPOSITION DISPLAYS INFORMATION THAT CONFORMS WITH1 SUBSECTION (1)(a) OF THIS SECTION AND IS APPROPRIATE FOR PATRONS OF2 ALL AGES.3 SECTION 2. In Colorado Revised Statutes, 35-65-401, repeal4 (9)(c) as follows:5 35-65-401. Colorado state fair authority - creation - board -6 powers and duties. (9) The board shall:7 (c) Hire and employ the manager of the Colorado state fair8 authority in accordance with the provisions of section 35-65-403;9 SECTION 3. In Colorado Revised Statutes, 35-65-403, amend10 (1) as follows:11 35-65-403. Office of manager of the Colorado state fair12 authority - creation. (1) The office of manager of the Colorado state fair13 authority is hereby created. The board COMMISSIONER OF AGRICULTURE ,14 IN CONSULTATION WITH THE BOARD, shall appoint AND EMPLOY a manager15 of the Colorado state fair authority. who shall THE PERSON APPOINTED16 AND EMPLOYED AS THE MANAGER MUST have knowledge of livestock,17 agriculture, horticulture, industry, recreation, education, and scientific18 facilities, processes, and products of the state of Colorado and who shall19 MUST have experience in fair management and promotion. The manager20 shall serve for an indefinite term, and shall MUST not hold any other21 public office, but shall AND MUST devote his or her THE MANAGER'S entire22 time to the service of the state in the discharge of his or her THE23 MANAGER'S official duties. The appointment or removal of the manager24 shall be IS subject to the provisions of section 13 of article XII of the state25 constitution and the statutes enacted pursuant thereto TO THAT SECTION.26 Notwithstanding any law to the contrary, the office of manager of the27 1022 -3- Colorado state fair authority shall be IS a position in the senior executive1 service for purposes of section 24-50-104 (5)(c). C.R.S.2 SECTION 4. Act subject to petition - effective date -3 applicability. (1) This act takes effect at 12:01 a.m. on the day following4 the expiration of the ninety-day period after final adjournment of the5 general assembly; except that, if a referendum petition is filed pursuant6 to section 1 (3) of article V of the state constitution against this act or an7 item, section, or part of this act within such period, then the act, item,8 section, or part will not take effect unless approved by the people at the9 general election to be held in November 2022 and, in such case, will take10 effect on the date of the official declaration of the vote thereon by the11 governor.12 (2) Section 3 of this act applies to the appointment of any manager13 of the Colorado state fair authority on or after the effective date of this14 act.15 1022 -4-
