2222 Be It Enacted by the Legislature of the State of Florida: 9

2424 Section 1. Subsection (4) of section 36 6.06, Florida 11
2525 Statutes, is amended to read: 12
2626 366.06 Rates; procedure for fixing and changing. — 13
2727 (4) A natural gas utility or a public electric utility 14
2828 whose annual sales to end -use customers amount to less than 1000 15
2929 500 gigawatt hours may specifically re quest the commission to 16
3030 process its petition for rate relief using the agency's proposed 17
3131 agency action procedure, as prescribed by commission rule. The 18
3232 commission shall enter its vote on the proposed agency action 19
3333 within 5 months of the commencement date f or final agency 20
3434 action. If the commission's proposed action is protested, the 21
3535 final decision must be rendered by the commission within 8 22
3636 months of the date the protest is filed. At the expiration of 5 23
3737 months following the commencement date for final agency action, 24
3838 if the commission has not taken action or if the commission's 25

5151 action is protested by a party other than the utility, the 26
5252 utility may place its requested rates into effect under bond, 27
5353 escrow, or corporate undertaking subject to refund, upon notice 28
5454 to the commission and upon filing the appropriate tariffs. The 29
5555 utility must keep accurate records of amounts received as 30
5656 provided by subsection (3). 31
5757 Section 2. This act shall take effect July 1, 2022. 32
