A bill to be entitled 1 
An act relating to natural gas and public utility 2 
petitions for rate relief; amending s. 366.06, F.S.; 3 
revising the number of gigawatt hours that certain 4 
utilities must sell to petition for rate relief using 5 
the Public Service Commission's proposed agency action 6 
procedure; providing an effective date. 7

Be It Enacted by the Legislature of the State of Florida: 9 
 10 
 Section 1.  Subsection (4) of section 36 6.06, Florida 11 
Statutes, is amended to read: 12 
 366.06  Rates; procedure for fixing and changing. — 13 
 (4)  A natural gas utility or a public electric utility 14 
whose annual sales to end -use customers amount to less than 1000 15 
500 gigawatt hours may specifically re quest the commission to 16 
process its petition for rate relief using the agency's proposed 17 
agency action procedure, as prescribed by commission rule. The 18 
commission shall enter its vote on the proposed agency action 19 
within 5 months of the commencement date f or final agency 20 
action. If the commission's proposed action is protested, the 21 
final decision must be rendered by the commission within 8 22 
months of the date the protest is filed. At the expiration of 5 23 
months following the commencement date for final agency action, 24 
if the commission has not taken action or if the commission's 25

action is protested by a party other than the utility, the 26 
utility may place its requested rates into effect under bond, 27 
escrow, or corporate undertaking subject to refund, upon notice 28 
to the commission and upon filing the appropriate tariffs. The 29 
utility must keep accurate records of amounts received as 30 
provided by subsection (3). 31 
 Section 2.  This act shall take effect July 1, 2022. 32
