5656 Section 1. Section 560.103, Florida Statutes, is amended 31

5858 560.103 Definitions. —As used in this chapter, the term: 33
5959 (1) "Affiliated party" m eans a control director, officer, 34
6060 responsible person, employee, or foreign affiliate of a money 35
6161 services business, or a person who has a controlling interest in 36
6262 a money services business as provided in s. 560.127. 37
6363 (2) "Appropriate regulator" means a stat e, federal, or 38
6464 foreign agency that has been granted authority to enforce state, 39
6565 federal, or foreign laws related to a money services business or 40
6666 deferred presentment provider. 41
6767 (3) "Authorized vendor" means a person designated by a 42
6868 money services business licensed under part II of this chapter 43
6969 to act on behalf of the licensee at locations in this state 44
7070 pursuant to a written contract with the licensee. 45
7171 (4) "Branch office" means the physical location, other 46
7272 than the principal place of business, of a money services 47
7373 business operated by a licensee under this chapter. 48
7474 (5) "Cashing" means providing currency for payment 49
7575 instruments except for travelers checks. 50

8888 (6) "Check casher" means a person who sells currency in 51

9292 (8) "Compliance officer" means the individual in charge of 55

101101 (a) A person who holds the title of president, chief 64
102102 executive officer, chief financial officer, chief operations 65
103103 officer, chief legal officer, or compliance officer for a money 66

105105 (b) A person who holds any of the officer positions named 68
106106 in the money services business's governing documents. 69
107107 (c) A person who holds any position named by the money 70
108108 services business's liability insurance coverage for directors 71
109109 and officers, if the business has such coverage. 72
110110 (d) A director of the money services business's board of 73

134134 all general partners, and those limited or special partners that 85
135135 have contributed 25 percent or more or that have the right to 86
136136 receive upon dissolution 25 percent or more of the partnership's 87

138138 (h) For a money services business that is a limited 89
139139 liability company, all managers, and those members that have 90
140140 contributed 25 percent or more or that have the right to receive 91
141141 upon dissolution 25 percent or more of the limited liability 92
142142 company's capital. 93
143143 (11)(10) "Corporate payment instrument" means a payment 94
144144 instrument on which the payee named on the instrument's face is 95
145145 other than a natural person. 96
146146 (12)(11) "Currency" means the coin and paper money of the 97
147147 United States or of any other country which is designated as 98
148148 legal tender and which circulates and is customarily used and 99
149149 accepted as a medium of exchange in the country of issuance. 100

176176 a stored value card or device that contains a microprocessor 115
177177 chip, magnetic stripe, or other means for storing information; 116
178178 that is prefunded; and for which the value is decremented upon 117

180180 (16)(15) "Financial audit report" means a report prepared 119
181181 in connection with a financial audit that i s conducted in 120
182182 accordance with generally accepted auditing standards prescribed 121
183183 by the American Institute of Certified Public Accountants by a 122
184184 certified public accountant licensed to do business in the 123
185185 United States, and which must include: 124

205205 (b) An expression of opinion regarding whether the 132
206206 financial statements are presented in conformity with accounting 133
207207 principles generally accepted in the United States, or an 134
208208 assertion to the effect that such an opinion cannot be expressed 135

210210 (17)(16) "Foreign affiliate" means a person located 137
211211 outside this state who has been designated by a licensee to make 138
212212 payments on behalf of the licensee to persons who reside outside 139
213213 this state. The term also includes a person located outside of 140
214214 this state for whom the licensee has been designated to make 141
215215 payments in this state. 142
216216 (18)(17) "Foreign currency exchanger" means a person who 143
217217 exchanges, for compensation, currency of the United States or a 144
218218 foreign government to currency of another government. 145
219219 (19)(18) "Fraudulent identification paraphernalia" means 146
220220 all equipment, products, or materials of an y kind that are used, 147
221221 intended for use, or designed for use in the misrepresentation 148
222222 of a customer's identity. The term includes, but is not limited 149

275275 (24)(23) "Money transmitter" means a corporation, limited 178
276276 liability company, limited liability partnership, or foreign 179

278278 currency, monetary value, or payment instruments for the purpose 181
279279 of transmitting the same by any means, including transmission by 182
280280 wire, facsimile, electronic transfer, courier, the Internet, or 183

284284 (25)(24) "Net worth" means assets minus liabilities, 187
285285 determined in accordance with United States generally accepted 188

287287 (26)(25) "Office" means the Office of Financial Regulation 190

289289 (26) "Officer" means an individual, other than a director, 192
290290 who participates in, or has authority to participate in, the 193
291291 major policymaking functions of a money services business, 194
292292 regardless of whether the individual has an official title or 195

294294 (27) "Outstanding money transmission" means a money 197
295295 transmission to a designated recipient or a refund to a sender 198

311311 (29) "Payment instrument" means a check, draft, warrant, 202
312312 money order, travelers check, electronic instrument, or other 203
313313 instrument, payment of money, or monetary value whether or not 204
314314 negotiable. The term does not include an instrument that is 205
315315 redeemable by the issuer in merchandise or service, a credit 206
316316 card voucher, or a letter of credit. 207
317317 (30) "Payment instrument seller" means a corporation, 208
318318 limited liability company, limited liability partnership, or 209
319319 foreign entity qualified to do business in this state which 210
320320 sells a payment instrument. 211
321321 (31) "Person" means an individual, partnership, 212
322322 association, trust, corporation, limited liability company, or 213
323323 other group, however organized, but does not include a public 214
324324 agency or instrumentality thereof. 215
325325 (32) "Personal identification information" means a 216
326326 customer's name that, alone or together with any of the 217
327327 following information, may be used to identify that specific 218
328328 customer: 219
329329 (a) Customer's signature. 220
330330 (b) Photograph, digital image, or other likeness of the 221
331331 customer. 222
332332 (c) Unique biometric data, such as the customer's 223
333333 thumbprint or fingerprint, voice print, retina or iris image, or 224
334334 other unique physical representation of the customer. 225

352352 (33) "Publicly traded" means a stock is currently traded 231
353353 on a national securities exchange registered with the Securities 232
354354 and Exchange Commission, or traded on an exchange in a country 233
355355 other than the United States regulated by a regulator equivalent 234
356356 to the Securities and Exchange Commission and the disclosure and 235
357357 reporting requirements of such regulator are substantially 236
358358 similar to those of the Securities and Exchange Commission. 237
359359 (34) "Sells" means to sell, issue, provide, or deliver. 238
360360 (35) "Stored value" means funds or monetary value 239
361361 represented in digital electronic form at, whether or not 240
362362 specially encrypted, and stored or capable of storage on 241
363363 electronic media in such a way as to be retrievable and 242
364364 transferred electronically. 243
365365 Section 2. Subsection (2) of section 560.118, Florida 244
366366 Statutes, is amended to read: 245

368368 (2) Each licensee must submit quarterly reports to the 247

393393 the commission, having a value greater than $10,000; to involve 260
394394 the proceeds of specified unlawful activity; or to be designed 261
395395 to evade the reporting requirements of this section or chapter 262
396396 896. The money services business must maintain appropriate 263
397397 procedures to ensure compliance with this section and chapter 264
398398 896. 265
399399 (d) A money services business, or control person officer, 266
400400 employee, or agent thereof, that files a report in good faith 267
401401 pursuant to this section is not liable to any person for loss or 268
402402 damage caused in whol e or in part by the making, filing, or 269
403403 governmental use of the report, or any information contained 270
404404 therein. 271

422422 controlling shareholders, or responsible persons of the licensee 277

424424 amendment in such form and at such t ime as specified by rule. 279
425425 (a) If any person, directly or indirectly or acting by or 280
426426 through one or more persons, proposes to purchase or acquire a 281
427427 controlling interest in a licensee, such person or group must 282
428428 submit an application for licensure as a mone y services business 283
429429 or deferred presentment provider before such purchase or 284
430430 acquisition at such time and in such form as prescribed by rule. 285
431431 As used in this subsection, the term "controlling interest" 286
432432 means the same as described in s. 560.127. 287
433433 (b) Upon the addition of a control person, the office 288
434434 shall evaluate the added control person and ensure that such 289
435435 person has submitted fingerprints for processing pursuant to s. 290
436436 560.141(1)(c) partner, officer, member, joint venturer, 291
437437 director, controlling sharehol der, or responsible person of the 292
438438 applicant who does not have a controlling interest and who has 293
439439 not previously complied with the applicable provisions of ss. 294
440440 560.1401 and 560.141 is subject to such provisions . If the 295
441441 office determines that the addition of the control person would 296
442442 cause the money services business to no longer the licensee does 297
443443 not continue to meet the licensure requirements under this 298
444444 chapter, the office may bring an administrative action in 299
445445 accordance with s. 560.114 to enforce the provis ions of this 300

470470 under this chapter, the applicant must submit: 313
471471 (a) An application to the office on forms prescribed by 314
472472 rule which includes the following information: 315
473473 1. The legal name and address of the applicant, including 316
474474 any fictitious or trade names used by the applicant in the 317
475475 conduct of its business. 318
476476 2. The date of the applicant's formation and the state in 319
477477 which the applicant was formed, if applicable. 320
478478 3. The name, social security number, alien identification 321
479479 or taxpayer identification number, business and residence 322
480480 addresses, and employment history for the past 5 years for each 323
481481 control person officer, director, responsible person, the 324
482482 compliance officer, each contr olling shareholder, and any other 325

499499 the applicant, and the disclosure of whether any parent or 330

501501 5. The applicant's history of operations in other states 332
502502 if applicable and a description of the money services business 333
503503 or deferred presentment provider activities pro posed to be 334
504504 conducted by the applicant in this state. 335
505505 6. If the applicant or its parent is a publicly traded 336
506506 company, copies of all filings made by the applicant with the 337
507507 United States Securities and Exchange Commission, or with a 338
508508 similar regulator in a country other than the United States, 339
509509 within the preceding year. 340
510510 7. The location at which the applicant proposes to 341
511511 establish its principal place of business and any other 342
512512 location, including branch offices and authorized vendors 343
513513 operating in this state. For each branch office and each 344
514514 location of an authorized vendor, the applicant shall include 345
515515 the nonrefundable fee required by s. 560.143. 346
516516 8. The name and address of the clearing financial 347
517517 institution or financial institutions through which the 348
518518 applicant's payment instruments are drawn or through which the 349

691691 560.114 Disciplinary actions; penalties. — 462
692692 (2) Pursuant to s. 120.60(6), the office may summarily 463
693693 suspend the license of a money services business if the office 464
694694 finds that a licensee poses an immediate, serious danger to the 465
695695 public health, safety, and welfare. A proceeding in which the 466
696696 office seeks the issuance of a final order for the summary 467
697697 suspension of a licensee shall be conducted by the commissioner 468
698698 of the office, or his or her designee, who shall issue such 469
699699 order. The following acts are deemed to constitute an immediate 470
700700 and serious danger to the public health, safety, and welfare, 471
701701 and the office may immediately suspend the license of a money 472
702702 services business if: 473
