ENROLLED CS/HB 1441 2023 Legislature CODING: Words stricken are deletions; words underlined are additions. hb1441-02-er Page 1 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 1 An act relating to a Florida Museum of Black History; 2 creating s. 267.0722, F.S.; creating a Florida Museum 3 of Black History Task Force within the Division of 4 Historical Resources of the Department of State; 5 providing for the appointment of task force members by 6 the Governor and the Legislature; providing 7 requirements for members of the task force; 8 prohibiting compensation for members of the task 9 force; providing that task force members are entitled 10 to receive reimbursement for per diem and travel 11 expenses; requiring the division to provide staff and 12 expend funds as necessary to assist the task force; 13 requiring the task force to develop certain plans and 14 recommendations; requiring the task force to submit a 15 report to the Governor and the Legislature before a 16 certain date; providing for the expiration of the task 17 force; authorizing the Legislature to consider the 18 commissioning, construction, operation, and 19 administration of a Florida Museum of Black History; 20 providing an effective date. 21 22 Be It Enacted by the Legislature of the State of Florida: 23 24 Section 1. Section 267.0722, Florida Statutes, is created 25 ENROLLED CS/HB 1441 2023 Legislature CODING: Words stricken are deletions; words underlined are additions. hb1441-02-er Page 2 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S to read: 26 267.0722 Florida Museum of Black History. — 27 (1) There is created within the division the Florida 28 Museum of Black History Task Force for the purpose of providing 29 recommendations to the division for the planning, construction, 30 operation, and administration of a Florida Museum of Black 31 History. The museum shall be a multipurpose facility capable of 32 generating self-sustaining revenues, with archival research and 33 storage facilities, meeting rooms, full service banquet 34 facilities that include a kitchen capable of serving at least 35 250 people at a single eve nt, and a performing arts theater that 36 shall be made available for private events. 37 (2) The task force shall be composed of nine members. 38 Three members shall be appointed by the Governor, three members 39 shall be appointed by the President of the Senate, an d three 40 members shall be appointed by the Speaker of the House of 41 Representatives. At least three of the appointed members must 42 have 5 or more years of experience in one of the following 43 areas: tenured faculty in history at a Florida public or private 44 university; historical research and publication; archival design 45 or preservation; multipurpose public building design or 46 construction; the hospitality and service industry; business; 47 finance; marketing; law; or education. All appointments shall be 48 made no later than July 31, 2023. 49 (3) Members of the task force shall serve without 50 ENROLLED CS/HB 1441 2023 Legislature CODING: Words stricken are deletions; words underlined are additions. hb1441-02-er Page 3 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S compensation or honorarium but shall be entitled to receive 51 reimbursement for per diem and travel expenses as provided in s. 52 112.061. 53 (4) The division shall provide the task force with staff 54 and expend funds as necessary to assist the task force in the 55 performance of its duties. 56 (5) The task force shall develop the following: 57 (a) Plans for the location, design, and construction of 58 the museum and all necessary facilities. 59 (b) Recommendations for the operation and administration 60 of the museum upon completion of construction. 61 (c) A marketing plan that may be executed by the Florida 62 Tourism Industry Marketing Corporation to promote the museum. 63 (d) A transition plan under which the museum will become 64 financially self-sufficient. 65 (e) Recommendations for archival and artifact acquisition, 66 preservation, and research; exhibits; installations; and 67 educational materials that complement and support required 68 instruction provided in pub lic schools in accordance with s. 69 1003.42(2)(h). The recommendations must include materials 70 relating to: 71 1. The history of slavery in the state. 77 3. The history of segregation in the state. 78 4. Notable African America ns in this state. 79 5. Dr. Mary McLeod Bethune, including the founding of 80 Bethune Cookman University. 81 6. The history of historically black colleges and 82 universities in this state. 83 7. The inherent worth and dignity of human life, with a 84 focus on the prevention of genocide. 85 (6) Before July 1, 2024, the task force shall submit a 86 report detailing its plans and recommendations to the Governor, 87 the President of the Senate, the Speaker of the House of 88 Representatives, the Minority Leader of the Senate, and t he 89 Minority Leader of the House of Representatives. Upon submission 90 of the report, the task force shall expire. 91 (7) After receiving the report of the task force, the 92 Legislature may consider legislation pertaining to the 93 commissioning, construction, oper ation, and administration of 94 the museum. 95 Section 2. This act shall take effect July 1, 2023. 96
