1515 An act relating to civil penalties under The Gas 2
1616 Safety Law of 1967; amending s. 368.061, F.S.; 3
1717 increasing the civil penalty amount for violating The 4
18-Gas Safety Law of 1967; requiring the Florida Public 5
19-Service Commission, after a date certain and annually 6
20-thereafter, to establish and revise maximum penalties 7
21-by rule based on specified factors; providing 8
22-rulemaking authority; providing an effective date . 9

24-Be It Enacted by the Legislature of the State of Florida: 11
25- 12
26- Section 1. Subsection (1) of section 368.061, Florida 13
27-Statutes, is amended, and subsection (4) is added to that 14
28-section, to read: 15
29- 368.061 Penalty.— 16
30- (1) A Any person who violates any provision of this part, 17
31-or any regulation issued hereunder, is shall be subject to a 18
32-civil penalty not to exceed the following: 19
33- (a) Until June 30, 2025, $266,015 $25,000 for each 20
34-violation for each day that the such violation persists, except 21
35-that the maximum civil penalty may shall not exceed $2,660,135 22
36-$500,000 for any related series of violations. 23
37- (b) After July 1, 2025, maximum penalties established by 24

51-such penalties, the commission must consider the penalties 26
52-established in paragraph (a) and make revisions based upon 27
53-consideration of the consumer price index, penalties established 28
54-in federal law for pipeline safety violations, and the intent of 29
55-the Legislature that the commission maintai n its certification 30
56-with the Pipeline and Hazardous Materials Safety Administration, 31
57-or any of its successor agencies, to enforce pipeline safety. 32
58-The commission shall review the penalties established in this 33
59-paragraph at least annually and revise, as nece ssary, using the 34
60-considerations specified in this paragraph. 35
61- (4) The commission may adopt rules to implement this 36
62-section. 37
63- Section 2. This act shall take effect July 1, 2024. 38
