A bill to be entitled 1 
An act relating to civil penalties under the Gas 2 
Safety Law of 1967; amending s. 368.061, F.S.; 3 
increasing the civil penalty amount for violating The 4 
Gas Safety Law of 1967; requiring the Florida Public 5 
Service Commission, after a date certain and annually 6 
thereafter, to establish and revise maximum penalties 7 
by rule based on specified factors; providing 8 
rulemaking authority; providing an effective date . 9 
 10 
Be It Enacted by the Legislature of the State of Florida: 11 
 12 
 Section 1.  Subsection (1) of section 368.061, Florida 13 
Statutes, is amended, and subsection (4) is added to that 14 
section, to read: 15 
 368.061  Penalty.— 16 
 (1)  A Any person who violates any provision of this part, 17 
or any regulation issued hereunder, is shall be subject to a 18 
civil penalty not to exceed the following: 19 
 (a)  Until June 30, 2025, $266,015 $25,000 for each 20 
violation for each day that the such violation persists, except 21 
that the maximum civil penalty may shall not exceed $2,660,135 22 
$500,000 for any related series of violations. 23 
 (b)  After July 1, 2025, maximum penalties established by 24 
the Florida Public Service Commission by rule. In establishing 25

such penalties, the commission must consider the penalties 26 
established in paragraph (a) and make revisions based upon 27 
consideration of the consumer price index, penalties established 28 
in federal law for pipeline safety violations, and the intent of 29 
the Legislature that the commission maintai n its certification 30 
with the Pipeline and Hazardous Materials Safety Administration, 31 
or any of its successor agencies, to enforce pipeline safety. 32 
The commission shall review the penalties established in this 33 
paragraph at least annually and revise, as nece ssary, using the 34 
considerations specified in this paragraph. 35 
 (4)  The commission may adopt rules to implement this 36 
section. 37 
 Section 2.  This act shall take effect July 1, 2024. 38
