18	18	adult to receive aftercare services; limiting the 5
19	19	aftercare services available to young adults under 6
20	20	certain circumstances; authorizing the Department of 7
21	21	Children and Families to distribute federal funds to 8
22	22	young adults, regardless of their eligibility, under 9
23	23	certain circumstances; providing an effective date. 10

25	25	Be It Enacted by the Legislature of the State of Florida: 12

27	27	Section 1. Subsection (11) of section 409.1451, Florida 14
28	28	Statutes, is renumbered as subsection (12), paragraph (a) of 15
29	29	subsection (3) is am ended, and a new subsection (11) is added to 16
30	30	that section, to read: 17
31	31	409.1451 The Road-to-Independence Program. — 18
32	32	(3) AFTERCARE SERVICES. — 19
33	33	(a)1. Aftercare services are available to a young adult 20
34	34	who has reached 18 years of age but is not yet 23 years o f age 21
35	35	who, having been placed by a court pursuant to chapter 39, has 22
36	36	lived in out-of-home care for at least 6 months after he or she 23
37	37	turned 14 years of age. A young adult who receives services and 24
38	38	support under subsection (2) or s. 39.6251 is only eligible for 25

51	51	aftercare services that are not otherwise covered or provided 26
52	52	under subsection (2) or s. 39.6251. and is: 27
53	53	a. Not in foster care. 28
54	54	b. Temporarily not receiving financial assistance under 29
55	55	subsection (2) to pursue postsecondary education. 30
56	56	2. Subject to available funding, aftercare services as 31
57	57	specified in subparagraph (b)8. are also available to a young 32
58	58	adult who is between the ages of 18 and 22, is receiving 33
59	59	financial assistance under subsection (2), is experiencing an 34
60	60	emergency situation, and whose resources are insufficient to 35
61	61	meet the emergency situation. Such assistance shall be in 36
62	62	addition to any amount specified in paragraph (2)(b). 37
63	63	(11) Notwithstanding the eligibility criteria or 38
64	64	availability of services and support under subsections (2) and 39
65	65	(3), the department may distribute federal funds to all young 40
66	66	adults deemed eligible by the funding source in the event of a 41
67	67	state of emergency declared by executive order or proclamation 42
68	68	of the Governor pursuant to chapter 252 or the President of the 43
69	69	United States. 44
70	70	Section 2. This act shall take effect July 1, 2024. 45
