21-managing entities to provide care coordinators for 8
22-certain students; requiring that a care coordinator 9
23-provided by the managing entity be placed in certain 10
24-school districts for specified purposes; requiring 11
25-school districts to address certain recommendations 12
26-and meet specified performance outcomes; requiring 13
27-each school district to report annually to the 14

29-outcomes and the allocation and expenditure of certain 16

34- Section 1. Section 1006.05, Florida Statutes, is cre ated 21

36- 1006.05 Mental health coordinated system of care. — 23
37- (1) For purposes of this section, the term "care 24
38-coordinator" means a person who is responsible for participating 25
16+children; creating s. 1006.05, F.S.; requiring certain 3
17+school districts to adhere to a specified mental 4
18+health and treatment support system for certain 5
19+children and meet specified performance outcomes; 6
20+requiring each school district to report annually to 7
21+the Department of Education on certain outcomes and 8
22+funding; providing an effective date. 9

24+Be It Enacted by the Legislature of the State of Florida: 11

26+ Section 1. Section 1006.05, Florida Statutes, is created 13
27+to read: 14
28+ 1006.05 Mental health coordinated system of care. — 15
29+ (1) Pursuant to s. 394.491 and to further promote the 16
30+effective implementation of a coordinated system of care 17
31+pursuant to ss. 394.4573 and 394.495, each school district that 18
32+provides mental health assessment, diagnosis, intervention, 19
33+treatment, and recovery services to students diagnosed with one 20
34+or more mental health or any co -occurring substance use disorder 21
35+and students at high risk of such diagnoses shall be guided by 22
36+and adhere to the guiding principles of the mental health 23
37+treatment and support system as provided under s. 394.491. 24
38+ (2)(a) Pursuant to s. 394.494, each school distr ict shall 25

51-in the development and implementation of a services plan, 26
52-linking service providers to a child or adolescent and his or 27
53-her family, monitoring the delivery of services, providing 28
54-advocacy, collecting information to determine the effect of 29
55-services and treatment, and performing care coordination as 30
56-defined in s. 394.4573(1). 31
57- (2) Pursuant to s. 394.491 and to further promote the 32
58-effective implementation of a coordinated system of care 33
59-pursuant to ss. 394.4573 and 394.495, each school district that 34
60-provides mental health assessment, diagnosis, intervention, 35
61-treatment, and recover y services to students diagnosed with one 36
62-or more mental health or any co -occurring substance use disorder 37
63-and students at high risk of such diagnoses must be guided by 38
64-and adhere to the guiding principles of the mental health 39
65-treatment and support system as provided under s. 394.491. 40
66- (3)(a) School districts shall contract with managing 41
67-entities to provide care coordinators for students with complex 42
68-behavioral health needs who continue to experience adverse 43
69-outcomes due to unmet needs or an inability to e ngage. 44
70- (b) A care coordinator provided by the managing entity 45
71-must be placed in each school district implementing a 46
72-coordinated system of care to ensure that students are receiving 47
73-necessary services and that appropriate funds are being used to 48
74-support the cost of treatment, including all available public 49
75-and private health insurance funds, before school -based mental 50

88-health treatment and support system funding is accessed to 51
89-purchase community-based services. 52
90- (c) When a student is identified as having e xperienced an 53
91-involuntary admission to an acute psychiatric care facility, 54
92-school districts must address recommendations from the care 55
93-coordinator provided by the managing entity upon the return of 56
94-the student to the school setting. 57
95- (4)(a) Pursuant to s. 394.494, each school district shall 58
96-meet the general performance outcomes for the child and 59
97-adolescent mental health treatment and support system. 60
98- (b) Each school district shall report annually to the 61
99-department on the general performance outcomes for t he child and 62
100-adolescent mental health treatment and support system and how 63
101-the support system funding is allocated and spent. 64
102- Section 2. This act shall take effect July 1, 2024. 65
