CS/CS/HB 1169 2024 CODING: Words stricken are deletions; words underlined are additions. hb1169-02-c2 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to coordinated systems of care for 2 children; creating s. 1006.05, F.S.; defining the term 3 "care coordinator"; requiring certain school districts 4 to be guided by and adhere to a specified mental 5 health and treatment support system for certain 6 children; requiring school districts to contract with 7 managing entities to provide care coordinators for 8 certain students; requiring that a care coordinator 9 provided by the managing entity be placed in certain 10 school districts for specified purposes; requiring 11 school districts to address certain recommendations 12 and meet specified performance outcomes; requiring 13 each school district to report annually to the 14 Department of Education on certain performance 15 outcomes and the allocation and expenditure of certain 16 funding; providing an effective date. 17 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Section 1006.05, Florida Statutes, is cre ated 21 to read: 22 1006.05 Mental health coordinated system of care. — 23 (1) For purposes of this section, the term "care 24 coordinator" means a person who is responsible for participating 25 CS/CS/HB 1169 2024 CODING: Words stricken are deletions; words underlined are additions. hb1169-02-c2 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S in the development and implementation of a services plan, 26 linking service providers to a child or adolescent and his or 27 her family, monitoring the delivery of services, providing 28 advocacy, collecting information to determine the effect of 29 services and treatment, and performing care coordination as 30 defined in s. 394.4573(1). 31 (2) Pursuant to s. 394.491 and to further promote the 32 effective implementation of a coordinated system of care 33 pursuant to ss. 394.4573 and 394.495, each school district that 34 provides mental health assessment, diagnosis, intervention, 35 treatment, and recover y services to students diagnosed with one 36 or more mental health or any co -occurring substance use disorder 37 and students at high risk of such diagnoses must be guided by 38 and adhere to the guiding principles of the mental health 39 treatment and support system as provided under s. 394.491. 40 (3)(a) School districts shall contract with managing 41 entities to provide care coordinators for students with complex 42 behavioral health needs who continue to experience adverse 43 outcomes due to unmet needs or an inability to e ngage. 44 (b) A care coordinator provided by the managing entity 45 must be placed in each school district implementing a 46 coordinated system of care to ensure that students are receiving 47 necessary services and that appropriate funds are being used to 48 support the cost of treatment, including all available public 49 and private health insurance funds, before school -based mental 50 CS/CS/HB 1169 2024 CODING: Words stricken are deletions; words underlined are additions. hb1169-02-c2 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S health treatment and support system funding is accessed to 51 purchase community-based services. 52 (c) When a student is identified as having e xperienced an 53 involuntary admission to an acute psychiatric care facility, 54 school districts must address recommendations from the care 55 coordinator provided by the managing entity upon the return of 56 the student to the school setting. 57 (4)(a) Pursuant to s. 394.494, each school district shall 58 meet the general performance outcomes for the child and 59 adolescent mental health treatment and support system. 60 (b) Each school district shall report annually to the 61 department on the general performance outcomes for t he child and 62 adolescent mental health treatment and support system and how 63 the support system funding is allocated and spent. 64 Section 2. This act shall take effect July 1, 2024. 65
