32+ Section 1. Section 1001.433, Florida Statutes, is created 19

34+ 1001.433 Patriotic Organizations. — 21
35+ (1) As used in this section, the term "patrio tic 22
36+organization" means a youth membership organization serving 23
37+young people under the age of 21 that is listed in Title 36, 24
38+U.S.C. ss. 30101, 30901, 31101, 40301, 70901, and 80301, as it 25

51- 1001.433 Patriotic organizations. 26
52- (1) As used in this section, the term "patriotic 27
53-organization" means a youth membership organization serving 28
54-young people under the age of 21 with an educational purpose 29
55-that promotes patriotism and civic involvement which is listed 30
56-in Title 36, U.S.C. ss. 30101, 30901, 31101, 40301, 70901, 31
57-80301, 130501, 140101, and 154101. 32
58- (2)(a) Each school district may: 33
59- 1. Allow a representative of a patriotic organization the 34
60-opportunity, during school hours and instructional time, to 35
61-speak with and distribute informational materials in a classroom 36
62-setting to students, to encourage participation in the patriotic 37
63-organization and its activities, and to inform students of how 38
64-the patriotic organization may further the students' educational 39
65-interests and civic involvement and better the students' school 40
66-and community and themselves. 41
67- 2. Provide opportunities for a patriotic organization to 42
68-provide displays at schools within the district for student 43
69-recruitment. Such displays may include informational flyers and 44
70-the use of other existing communication channels. 45
71- (b) If a school district authorizes a representative of a 46
72-patriotic organization to speak with and distribute 47
73-informational materials to students and provide displays 48
74-pursuant to paragraph (a), the school district: 49
75- 1. Must provide a specific date and time fo r the patriotic 50

51+existed on January 1, 2020, with an educational purpose that 26
52+promotes patriotism and civic involvement. 27
53+ (2)(a) Each school district may: 28
54+ 1. Allow a representative of a patriotic organization the 29
55+opportunity, during school hours and instructional time, to 30
56+speak with and distribute informational materials in a classroom 31
57+setting to students to encourage participation in the patriotic 32
58+organization and its activities and inform students of how the 33
59+patriotic organization may further the students' educational 34
60+interests and civic involvement to better the students' school 35
61+and community and themselves. 36
62+ 2. Provide opportunities for a patriotic organization to 37
63+have displays at schools within the district to provide 38
64+opportunities for student recruitment. Such displays may include 39
65+informational flyers and the use of other existing communication 40

67+ (b) If a school district authorizes a representative of a 42
68+patriotic organization to speak with and distribute 43
69+informational materials to students and provide displays 44
70+pursuant to paragraph (a), the school district must provide a 45
71+specific day and time for the patriotic organization to speak to 46
72+students at schools within the district after the patriotic 47
73+organization has provided reasonable notice of its intent to 48
74+speak to students and provide displays. 49
75+ (3) A patriotic organization may be allowed the use of any 50

88-organization to speak to students at schools within the district 51
89-after the patriotic organization has provided reasonable notice 52
90-of its intent to speak to students and provide displays. 53
91- 2. Must notify parents or guardians of each patrioti c 54
92-organization's expected presentation and the option to withhold 55
93-consent for their child participating in such presentation. 56
94- (3) A school district may not discriminate against an 57
95-organization in subsection (1) in the use of any school building 58
96-or property for the purposes of paragraphs (2)(a) and (b), if 59
97-such activities occur outside of the school day. 60
98- (4) A school district that allows a patriotic organization 61
99-to speak with and distribute informational materials to students 62
100-or use school buildings or p roperty pursuant to this section is 63
101-not required to provide equal access to an organization that is 64
102-not designated as a patriotic organization. 65
103- Section 2. This act shall take effect July 1, 2024. 66
