An act relating to patriotic organizations; creating 2 
s. 1001.433, F.S.; defining the term "patriotic 3 
organization"; authorizing school districts to allow 4 
representatives of patriotic organizations to speak to 5 
students, distribute certain materials, and provide 6 
opportunities for certain displays relating to the 7 
patriotic organizations; requiring certain school 8 
districts to provide a date and time for such 9 
patriotic organizations to speak with students, 10 
distribute materials, and provide certain displays; 11 
specifying certain requirements if a school district 12 
allows a patriotic organization to present at the 13 
school; prohibiting a school district from 14 
discriminating against certain organizations in the 15 
use of a school building or property under certain 16 
circumstances; authorizing patriotic organizations to 17 
be provided certain access to school buildings and 18 
properties under certain circumstances; providing 19 
construction; providing an effective date. 20

Be It Enacted by the Legislature of the State of Florida: 22 
 23 
 Section 1.  Section 1001.433, Florida Statutes, is created 24 
to read: 25

 1001.433  Patriotic organizations. — 26 
 (1)  As used in this section, the term "patriotic 27 
organization" means a youth membership organization serving 28 
young people under the age of 21 with an educational purpose 29 
that promotes patriotism and civic involvement which is listed 30 
in Title 36, U.S.C. ss. 30101, 30901, 31101, 40301, 70901, 31 
80301, 130501, 140101, and 154101. 32 
 (2)(a)  Each school district may: 33 
 1.  Allow a representative of a patriotic organization the 34 
opportunity, during school hours and instructional time, to 35 
speak with and distribute informational materials in a classroom 36 
setting to students, to encourage participation in the patriotic 37 
organization and its activities, and to inform students of how 38 
the patriotic organization may further the students' educational 39 
interests and civic involvement and better the students' school 40 
and community and themselves. 41 
 2.  Provide opportunities for a patriotic organization to 42 
provide displays at schools within the district for student 43 
recruitment. Such displays may include informational flyers and 44 
the use of other existing communication channels. 45 
 (b)  If a school district authorizes a representative of a 46 
patriotic organization to speak with and distribute 47 
informational materials to students and provide displays 48 
pursuant to paragraph (a), the school district: 49 
 1.  Must provide a specific date and time fo r the patriotic 50

organization to speak to students at schools within the district 51 
after the patriotic organization has provided reasonable notice 52 
of its intent to speak to students and provide displays. 53 
 2.  Must notify parents or guardians of each patrioti c 54 
organization's expected presentation and the option to withhold 55 
consent for their child participating in such presentation. 56 
 (3)  A school district may not discriminate against an 57 
organization in subsection (1) in the use of any school building 58 
or property for the purposes of paragraphs (2)(a) and (b), if 59 
such activities occur outside of the school day. 60 
 (4)  A school district that allows a patriotic organization 61 
to speak with and distribute informational materials to students 62 
or use school buildings or p roperty pursuant to this section is 63 
not required to provide equal access to an organization that is 64 
not designated as a patriotic organization. 65 
 Section 2.  This act shall take effect July 1, 2024. 66
