2727 Be It Enacted by the Legislature of the State of Florida: 14

2929 Section 1. Subsection (1) of section 24.10 51, Florida 16
3030 Statutes, is amended to read: 17
3131 24.1051 Exemptions from inspection or copying of public 18
3232 records.— 19
3333 (1)(a) The following information held by the department is 20
3434 confidential and exempt from s. 119.07(1) and s. 24(a), Art. I 21
3535 of the State Constitut ion: 22
3636 1. Information that, if released, could harm the security 23
3737 or integrity of the department, including: 24
3838 a. Information relating to the security of the 25

5151 department's technologies, processes, and practices designed to 26
5252 protect networks, computers, data p rocessing software, data, and 27
5353 data systems from attack, damage, or unauthorized access. This 28
5454 sub-subparagraph is subject to the Open Government Sunset Review 29
5555 Act in accordance with s. 119.15 and shall stand repealed on 30
5656 October 2, 2027, unless reviewed and saved from repeal through 31
5757 reenactment by the Legislature. 32
5858 b. Security information or information that would reveal 33
5959 security measures of the department, whether physical or 34
6060 virtual. 35
6161 c. Information about lottery games, promotions, tickets, 36
6262 and ticket stock, including information concerning the 37
6363 description, design, production, printing, packaging, shipping, 38
6464 delivery, storage, and validation of such games, promotions, 39
6565 tickets, and stock. 40
6666 d. Information concerning terminals, machines, and devices 41
6767 that issue tickets. 42
6868 2. Information that must be maintained as confidential in 43
6969 order for the department to participate in a multistate lottery 44
7070 association or game. 45
7171 3. Personal identifying information obtained by the 46
7272 department when processing background investig ations of current 47
7373 or potential retailers or vendors. 48
7474 4. Financial information about an entity which is not 49
7575 publicly available and is provided to the department in 50

8888 connection with its review of the financial responsibility of 51
8989 the entity pursuant to s. 24. 111 or s. 24.112, provided that the 52
9090 entity marks such information as confidential. However, 53
9191 financial information related to any contract or agreement, or 54
9292 an addendum thereto, with the department, including the amount 55
9393 of money paid, any payment structure o r plan, expenditures, 56
9494 incentives, bonuses, fees, and penalties, shall be public 57
9595 record. 58
9696 (b) This exemption is remedial in nature, and it is the 59
9797 intent of the Legislature that this exemption apply to 60
9898 information held by the department before, on, or after May 14, 61
9999 2019. 62
100100 (c) Information made confidential and exempt under this 63
101101 subsection may be released to other governmental entities as 64
102102 needed in connection with the performance of their duties. The 65
103103 receiving governmental entity shall maintain the confidential 66
104104 and exempt status of such information. 67
105105 (d) This subsection is subject to the Open Government 68
106106 Sunset Review Act in accordance with s. 119.15 and shall stand 69
107107 repealed on October 2, 2024, unless reviewed and saved from 70
108108 repeal through reenactmen t by the Legislature. 71
109109 Section 2. This act shall take effect October 1, 2024. 72
