17	17	providing for future legislative review and repeal of 4
18	18	an exemption from public record requirements relating 5
19	19	to the security of certain technologies, processes, 6
20	20	and practices; removing the scheduled repeal of 7
21	21	exemptions relating to information about lottery 8
22	22	games, personal identifying information of retailers 9
23	23	and vendors for purposes of background checks, and 10
24	24	certain financial information held by the Department 11
25	25	of the Lottery; providing an effective date. 12

27	27	Be It Enacted by the Legislature of the State of Florida: 14
28	28	15
29	29	Section 1. Subsection (1) of section 24.10 51, Florida 16
30	30	Statutes, is amended to read: 17
31	31	24.1051 Exemptions from inspection or copying of public 18
32	32	records.— 19
33	33	(1)(a) The following information held by the department is 20
34	34	confidential and exempt from s. 119.07(1) and s. 24(a), Art. I 21
35	35	of the State Constitut ion: 22
36	36	1. Information that, if released, could harm the security 23
37	37	or integrity of the department, including: 24

51	51	department's technologies, processes, and practices designed to 26
52	52	protect networks, computers, data p rocessing software, data, and 27
53	53	data systems from attack, damage, or unauthorized access. This 28
54	54	sub-subparagraph is subject to the Open Government Sunset Review 29
55	55	Act in accordance with s. 119.15 and shall stand repealed on 30
56	56	October 2, 2027, unless reviewed and saved from repeal through 31
57	57	reenactment by the Legislature. 32
58	58	b. Security information or information that would reveal 33
59	59	security measures of the department, whether physical or 34
60	60	virtual. 35
61	61	c. Information about lottery games, promotions, tickets, 36
62	62	and ticket stock, including information concerning the 37
63	63	description, design, production, printing, packaging, shipping, 38
64	64	delivery, storage, and validation of such games, promotions, 39
65	65	tickets, and stock. 40
66	66	d. Information concerning terminals, machines, and devices 41
67	67	that issue tickets. 42
68	68	2. Information that must be maintained as confidential in 43
69	69	order for the department to participate in a multistate lottery 44
70	70	association or game. 45
71	71	3. Personal identifying information obtained by the 46
72	72	department when processing background investig ations of current 47
73	73	or potential retailers or vendors. 48
74	74	4. Financial information about an entity which is not 49
75	75	publicly available and is provided to the department in 50

88	88	connection with its review of the financial responsibility of 51
89	89	the entity pursuant to s. 24. 111 or s. 24.112, provided that the 52
90	90	entity marks such information as confidential. However, 53
91	91	financial information related to any contract or agreement, or 54
92	92	an addendum thereto, with the department, including the amount 55
93	93	of money paid, any payment structure o r plan, expenditures, 56
94	94	incentives, bonuses, fees, and penalties, shall be public 57
95	95	record. 58
96	96	(b) This exemption is remedial in nature, and it is the 59
97	97	intent of the Legislature that this exemption apply to 60
98	98	information held by the department before, on, or after May 14, 61
99	99	2019. 62
100	100	(c) Information made confidential and exempt under this 63
101	101	subsection may be released to other governmental entities as 64
102	102	needed in connection with the performance of their duties. The 65
103	103	receiving governmental entity shall maintain the confidential 66
104	104	and exempt status of such information. 67
105	105	(d) This subsection is subject to the Open Government 68
106	106	Sunset Review Act in accordance with s. 119.15 and shall stand 69
107	107	repealed on October 2, 2024, unless reviewed and saved from 70
108	108	repeal through reenactmen t by the Legislature. 71
109	109	Section 2. This act shall take effect October 1, 2024. 72
