HB 7045 2024 CODING: Words stricken are deletions; words underlined are additions. hb7045-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to a review under the Open Government 2 Sunset Review Act; amending s. 24.1051, F.S.; 3 providing for future legislative review and repeal of 4 an exemption from public record requirements relating 5 to the security of certain technologies, processes, 6 and practices; removing the scheduled repeal of 7 exemptions relating to information about lottery 8 games, personal identifying information of retailers 9 and vendors for purposes of background checks, and 10 certain financial information held by the Department 11 of the Lottery; providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Subsection (1) of section 24.10 51, Florida 16 Statutes, is amended to read: 17 24.1051 Exemptions from inspection or copying of public 18 records.— 19 (1)(a) The following information held by the department is 20 confidential and exempt from s. 119.07(1) and s. 24(a), Art. I 21 of the State Constitut ion: 22 1. Information that, if released, could harm the security 23 or integrity of the department, including: 24 a. This 28 sub-subparagraph is subject to the Open Government Sunset Review 29 Act in accordance with s. 119.15 and shall stand repealed on 30 October 2, 2027, unless reviewed and saved from repeal through 31 reenactment by the Legislature. 32 b. Security information or information that would reveal 33 security measures of the department, whether physical or 34 virtual. 35 c. Information about lottery games, promotions, tickets, 36 and ticket stock, including information concerning the 37 description, design, production, printing, packaging, shipping, 38 delivery, storage, and validation of such games, promotions, 39 tickets, and stock. 40 d. Information concerning terminals, machines, and devices 41 that issue tickets. 42 2. Information that must be maintained as confidential in 43 order for the department to participate in a multistate lottery 44 association or game. 45 3. Personal identifying information obtained by the 46 department when processing background investig ations of current 47 or potential retailers or vendors. 48 4. Financial information about an entity which is not 49 publicly available and is provided to the department in 50 HB 7045 2024 CODING: Words stricken are deletions; words underlined are additions. hb7045-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S connection with its review of the financial responsibility of 51 the entity pursuant to s. 24. 111 or s. 24.112, provided that the 52 entity marks such information as confidential. However, 53 financial information related to any contract or agreement, or 54 an addendum thereto, with the department, including the amount 55 of money paid, any payment structure o r plan, expenditures, 56 incentives, bonuses, fees, and penalties, shall be public 57 record. 58 (b) This exemption is remedial in nature, and it is the 59 intent of the Legislature that this exemption apply to 60 information held by the department before, on, or after May 14, 61 2019. 62 (c) Information made confidential and exempt under this 63 subsection may be released to other governmental entities as 64 needed in connection with the performance of their duties. The 65 receiving governmental entity shall maintain the confidential 66 and exempt status of such information. 67 (d) This subsection is subject to the Open Government 68 Sunset Review Act in accordance with s. 119.15 and shall stand 69 repealed on October 2, 2024, unless reviewed and saved from 70 repeal through reenactmen t by the Legislature. 71 Section 2. This act shall take effect October 1, 2024. 72
