61	131		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

63	132		SECTION 1. AMENDATORY 74 O.S. 2011, Section 18b, as last
64	133		amended by Section 1, Chapter 444, O.S.L. 2019 (74 O.S. Supp. 2020,
65	134		Section 18b), is amended to r ead as follows:

67	135		Section 18b. A. The duties of the Attorney General as the
68	136		chief law officer of the state shall be:
69		-
70	137		1. To appear for the state and prosecute and defend all actions
71	138		and proceedings, civil or criminal, in the Supreme Court and Court
72	139		of Criminal Appeals in which the state is interested as a party;

80	171		at the request of the Governor, the Legislature, or either branch

83	174		criminal, in which the state may be a party or interested; and when
84	175		so appearing in any such cause or proceeding, the Attorney General
85	176		may, if the Attorney General deems it advisable and to the best
86	177		interest of the state, take and ass ume control of the prosecution or

90	180		requested by them, in all matters pertaining to the duties of their

104	218		6. At the request of the Governor, State Auditor and Inspector,
105	219		State Treasurer, or either branch of the Legislature, to prosecute
106	220		any official bond or any contract in which the state is interested,
107	221		upon a breach thereof, and to prosecute or defend for the state all
108	222		actions, civil or criminal, relating to any matter connected with
109	223		either of their Departments;

111	224		7. Whenever requested by any state officer, board or
112	225		commission, to prepare proper drafts fo r contracts, forms and other
113	226		writing which may be wanted for the use of the state;

115	227		8. To prepare drafts of bills and resolutions for individual
116	228		members of the Legislature upon their written request stating the
117	229		gist of the bill or resolution desired;

119	230		9. To enforce the proper application of monies appropriated by
120	231		the Legislature and to prosecute breaches of trust in the
121	232		administration of such funds;

123	233		10. To institute actions to recover state monies illegally
124	234		expended, to recover state property and to preven t the illegal use
125	235		of any state property, upon the request of the Governor or the
126	236		Legislature;

128	237		11. To pay into the State Treasury, immediately upon its
129	238		receipt, all monies received by the Attorney General belonging to
130	239		the state;

132	266		12. To settle, compromise and dispose of an action in which the
133	267		Attorney General represents the interests of the state, so long as
134	268		the consideration negotiated for such settlement, compromise or

136	270		a named party of the action and any monies, any property or other
137	271		item of value is paid first to the State Treasury;

139	272		13. To keep and file copies of all opinions, contracts, forms
140	273		and letters of the office, and to keep an index of all opinions,
141	274		contracts and forms according to subject and section of the law
142	275		construed or applied;

144	276		14. To keep a register or docket of all actions, demands and
145	277		investigations prosecuted, defended or conducted by the Attorney
146	278		General in behalf of the state. The register or docket shall give
147	279		the style of the case or investigation, where pending, court number,
148	280		office number, the gist of the matter, result and the names of the
149	281		assistants who handled the matter;

151	282		15. To keep a complete office file of all cases and
152	283		investigations handled by the Attorney General on behalf of the
153	284		state;

155	285		16. To report to the Legislature or either branch thereof
156	286		whenever requested upon any business relating to the duties of the
157	287		Attorney General's office;

159	288		17. To institute civil actions against members of any state
160	289		board or commission for failure of such members to perform their

162	317		prosecute members of any state board or commission for violation of
163	318		the criminal laws of this state where such violations have occurred
164	319		in connection with the performance of such members' official duties;

166	320		18. To respond to any request for an opinion of the Attorney
167	321		General's office, submitted by a member of the Legislature,
168	322		regardless of subject matter, by written opinion determinative o f
169	323		the law regarding such subject matter;

171	324		19. To convene multicounty grand juries in such manner and for
172	325		such purposes as provided by law; provided, such grand juries are
173	326		composed of citizens from each of the counties on a pro rata basis
174	327		by county;

176	328		20. To investigate any report by the State Auditor and
177	329		Inspector filed with the Attorney General pursuant to Section 223 of
178	330		this title and prosecute all actions, civil or criminal, relating to

180	332		of public funds or property which are violations of the laws of this

183	334		21. To represent and protect the collective interests of all
184	335		utility consumers of this state in rate -related proceedings before
185	336		the Corporation Commission or in any other state or federal judicial
186	337		or administrative proceeding;

188	338		22. To represent and protect the collective interests of
189	339		insurance consumers of this state in rate -related proceedings before

193	368		23. To investigate and prosecute any criminal action relating
194	369		to insurance fraud, if in the opinion of the Attorney General a
195	370		criminal prosecution is warranted, or to refer such matters to the
196	371		appropriate district attorney ; and

198	372		24. To monitor and evaluate any action by the federal
199	373		government including, but not limited to, executive orders by the
200	374		President of the United States, rules or regulations promulgated by
201	375		an agency of the federal government or acts of Congress to determine
202	376		if such actions are in violation of the Tenth Amendment to the
203	377		Constitution of the United States .

205	378		B. Nothing in this section shall be construed as requiring the
206	379		Attorney General to appear and defend or prosecute in any court any
207	380		cause or proceeding for or on behalf of the Oklahoma Tax Commission,
208	381		the Board of Managers of the State Insurance Fund, or the
209	382		Commissioners of the Land Office.

211	383		C. In all appeals from the Corporation Commission to the
212	384		Supreme Court of Oklahoma in which the state is a party, the
213	385		Attorney General shall have the right to designate counsel of the
214	386		Corporation Commission as the Attorney General's legally appointed
215	387		representative in such appeals, and it shall be the duty of the
216	388		Corporation Commission counsel to act when so designated and to

220	417		SECTION 2. NEW LAW A new section of law to be codified
221	418		in the Oklahoma Statutes as Section 18q of Title 74, unless there is
222	419		created a duplication in numbering, reads as follows:

224	420		There is hereby created within the Office of the Attorney
225	421		General a State Reserved Powers Protection Unit to monitor and
226	422		evaluate any action by the federal government including, but not
227	423		limited to, executive or ders by the President of the United States,
228	424		rules or regulations promulgated by an agency of the federal
229	425		government or acts of Congress to determine if such actions are in
230	426		violation of the Tenth Amendment to the Constitution of the United
231	427		States. If review by the Unit of any such action by the federal
232	428		government concludes that the action is an infringement on state
233	429		authority under the Tenth Amendment, the Attorney General shall
234	430		determine whether the state should seek an exemption from the
235	431		application of the action or seek to have the action declared
236	432		unconstitutional.

238	433		SECTION 3. NEW LAW A new section of law to be codified
239	434		in the Oklahoma Statutes as Section 101 of Title 80, unless there is
240	435		created a duplication in numbering, reads as follows:

242	436		A. The Legislature may review any executive order issued by the
243	437		President of the United States, federal agency rule or federal
244	438		congressional action to determine the constitutionality of such

245	465		action. Upon recommendation from the Legislature, the Attorney
246	466		General, through the State Reserved Powers Protection Unit, shall
247	467		review such action by the federal government to determine the
248	468		constitutionality of the action and whether the state should seek an
249	469		exemption from the application of the action or se ek to have the
250	470		action declared unconstitutional by a court of competent
251	471		jurisdiction and prevent, prohibit or enjoin enforcement of the
252	472		unconstitutional order, rule or action.

254	473		B. Should the Attorney General decline to pursue action based
255	474		upon the determination of the Legislature, the Legislature may by a
256	475		majority vote initiate an action to seek an exemption from the
257	476		application of the action or seek to have the action declared
258	477		unconstitutional by a court of competent jurisdiction and prevent,
259	478		prohibit or enjoin enforcement of the unconstitutional order, rule
260	479		or action.

262	480		C. Notwithstanding any other provision of law, the state,
263	481		county, political subdivision or any other publicly funded
264	482		organization shall not implement, adopt or enforce any order,
265	483		federal agency rule or federal congressional action declared
266	484		unconstitutional by a court of competent jurisdiction under
267	485		subsection A or B of this section including, but not limited to:

269	486		1. Pandemics or other health emergencies;

293	527		SECTION 4. This act shall become effective July 1, 2021.

295	528		SECTION 5. It being immediately necessary for the preservation
296	529		of the public peace, health or safety, an em ergency is hereby
297	530		declared to exist, by reason whereof this act shall take effect and
298	531		be in full force from and after its passage and approval.
