61131 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

63132 SECTION 1. AMENDATORY 74 O.S. 2011, Section 18b, as last
64133 amended by Section 1, Chapter 444, O.S.L. 2019 (74 O.S. Supp. 2020,
65134 Section 18b), is amended to r ead as follows:

67135 Section 18b. A. The duties of the Attorney General as the
68136 chief law officer of the state shall be:

70137 1. To appear for the state and prosecute and defend all actions
71138 and proceedings, civil or criminal, in the Supreme Court and Court
72139 of Criminal Appeals in which the state is interested as a party;

74166 2. To appear for the state and prosecute and defend all actions
75167 and proceedings in any of the federal courts in which the state is
76168 interested as a party;

78169 3. To initiate or appear in any action in which the interests
79170 of the state or the people of the state are at issue, or to appear
80171 at the request of the Governor, the Legislature, or either branch
81172 thereof, and prosecute and defend in any court or before any
82173 commission, board or officers any cause or proceeding, civil or
83174 criminal, in which the state may be a party or interested; and when
84175 so appearing in any such cause or proceeding, the Attorney General
85176 may, if the Attorney General deems it advisable and to the best
86177 interest of the state, take and ass ume control of the prosecution or
87178 defense of the state's interest therein;

89179 4. To consult with and advise district attorneys, when
90180 requested by them, in all matters pertaining to the duties of their

104218 6. At the request of the Governor, State Auditor and Inspector,
105219 State Treasurer, or either branch of the Legislature, to prosecute
106220 any official bond or any contract in which the state is interested,
107221 upon a breach thereof, and to prosecute or defend for the state all
108222 actions, civil or criminal, relating to any matter connected with
109223 either of their Departments;

111224 7. Whenever requested by any state officer, board or
112225 commission, to prepare proper drafts fo r contracts, forms and other
113226 writing which may be wanted for the use of the state;

115227 8. To prepare drafts of bills and resolutions for individual
116228 members of the Legislature upon their written request stating the
117229 gist of the bill or resolution desired;

119230 9. To enforce the proper application of monies appropriated by
120231 the Legislature and to prosecute breaches of trust in the
121232 administration of such funds;

123233 10. To institute actions to recover state monies illegally
124234 expended, to recover state property and to preven t the illegal use
125235 of any state property, upon the request of the Governor or the
126236 Legislature;

128237 11. To pay into the State Treasury, immediately upon its
129238 receipt, all monies received by the Attorney General belonging to
130239 the state;

132266 12. To settle, compromise and dispose of an action in which the
133267 Attorney General represents the interests of the state, so long as
134268 the consideration negotiated for such settlement, compromise or
135-disposition is payable to the state or one of its agencies which is ENR. H. B. NO. 1236 Page 4
269+disposition is payable to the state or one of its agencies which is
136270 a named party of the action and any monies, any property or other
137271 item of value is paid first to the State Treasury;

139272 13. To keep and file copies of all opinions, contracts, forms
140273 and letters of the office, and to keep an index of all opinions,
141274 contracts and forms according to subject and section of the law
142275 construed or applied;

144276 14. To keep a register or docket of all actions, demands and
145277 investigations prosecuted, defended or conducted by the Attorney
146278 General in behalf of the state. The register or docket shall give
147279 the style of the case or investigation, where pending, court number,
148280 office number, the gist of the matter, result and the names of the
149281 assistants who handled the matter;

151282 15. To keep a complete office file of all cases and
152283 investigations handled by the Attorney General on behalf of the
153284 state;

155285 16. To report to the Legislature or either branch thereof
156286 whenever requested upon any business relating to the duties of the
157287 Attorney General's office;

159288 17. To institute civil actions against members of any state
160289 board or commission for failure of such members to perform their

161316 duties as prescribed by the statutes and the Constitution and to
162317 prosecute members of any state board or commission for violation of
163318 the criminal laws of this state where such violations have occurred
164319 in connection with the performance of such members' official duties;

166320 18. To respond to any request for an opinion of the Attorney
167321 General's office, submitted by a member of the Legislature,
168322 regardless of subject matter, by written opinion determinative o f
169323 the law regarding such subject matter;

171324 19. To convene multicounty grand juries in such manner and for
172325 such purposes as provided by law; provided, such grand juries are
173326 composed of citizens from each of the counties on a pro rata basis
174327 by county;

176328 20. To investigate any report by the State Auditor and
177329 Inspector filed with the Attorney General pursuant to Section 223 of
178330 this title and prosecute all actions, civil or criminal, relating to

180332 of public funds or property which are violations of the laws of this
181333 state;

183334 21. To represent and protect the collective interests of all
184335 utility consumers of this state in rate -related proceedings before
185336 the Corporation Commission or in any other state or federal judicial

188338 22. To represent and protect the collective interests of
189339 insurance consumers of this state in rate -related proceedings before

190366 the Insurance Commissioner or in any other state or federal judicial
191367 or administrative proceeding; and

193368 23. To investigate and prosecute any criminal action relating
194369 to insurance fraud, if in the opinion of the Attorney General a
195370 criminal prosecution is warranted, or to refer such matters to the
196371 appropriate district attorney ; and

198372 24. To monitor and evaluate any action by the federal
199373 government including, but not limited to, executive orders by the
200374 President of the United States, rules or regulations promulgated by
201375 an agency of the federal government or acts of Congress to determine
202376 if such actions are in violation of the Tenth Amendment to the
203377 Constitution of the United States .

205378 B. Nothing in this section shall be construed as requiring the
206379 Attorney General to appear and defend or prosecute in any court any
207380 cause or proceeding for or on behalf of the Oklahoma Tax Commission,
208381 the Board of Managers of the State Insurance Fund, or the
209382 Commissioners of the Land Office.

211383 C. In all appeals from the Corporation Commission to the
212384 Supreme Court of Oklahoma in which the state is a party, the
213385 Attorney General shall have the right to designate counsel of the
214386 Corporation Commission as the Attorney General's legally appointed
215387 representative in such appeals, and it shall be the duty of the
216388 Corporation Commission counsel to act when so designated and to

220417 SECTION 2. NEW LAW A new section of law to be codified
221418 in the Oklahoma Statutes as Section 18q of Title 74, unless there is
222419 created a duplication in numbering, reads as follows:

224420 There is hereby created within the Office of the Attorney
225421 General a State Reserved Powers Protection Unit to monitor and
226422 evaluate any action by the federal government including, but not
227423 limited to, executive or ders by the President of the United States,
228424 rules or regulations promulgated by an agency of the federal
229425 government or acts of Congress to determine if such actions are in
230426 violation of the Tenth Amendment to the Constitution of the United
231427 States. If review by the Unit of any such action by the federal
232428 government concludes that the action is an infringement on state
233429 authority under the Tenth Amendment, the Attorney General shall
234430 determine whether the state should seek an exemption from the
235431 application of the action or seek to have the action declared
236432 unconstitutional.

238433 SECTION 3. NEW LAW A new section of law to be codified
239434 in the Oklahoma Statutes as Section 101 of Title 80, unless there is
240435 created a duplication in numbering, reads as follows:

242436 A. The Legislature may review any executive order issued by the
243437 President of the United States, federal agency rule or federal
244438 congressional action to determine the constitutionality of such

245465 action. Upon recommendation from the Legislature, the Attorney
246466 General, through the State Reserved Powers Protection Unit, shall
247467 review such action by the federal government to determine the
248468 constitutionality of the action and whether the state should seek an
249469 exemption from the application of the action or se ek to have the
250470 action declared unconstitutional by a court of competent
251471 jurisdiction and prevent, prohibit or enjoin enforcement of the
252472 unconstitutional order, rule or action.

254473 B. Should the Attorney General decline to pursue action based
255474 upon the determination of the Legislature, the Legislature may by a
256475 majority vote initiate an action to seek an exemption from the
257476 application of the action or seek to have the action declared
258477 unconstitutional by a court of competent jurisdiction and prevent,
259478 prohibit or enjoin enforcement of the unconstitutional order, rule
260479 or action.

262480 C. Notwithstanding any other provision of law, the state,
263481 county, political subdivision or any other publicly funded
264482 organization shall not implement, adopt or enforce any order,
265483 federal agency rule or federal congressional action declared
266484 unconstitutional by a court of competent jurisdiction under
267485 subsection A or B of this section including, but not limited to:

287523 extracurricular sports sponsored by an institution of higher
288524 education, a school district or a charter school; or

290525 9. Any other powers res erved by the State of Oklahoma or the
291526 people of Oklahoma.

293527 SECTION 4. This act shall become effective July 1, 2021.

295528 SECTION 5. It being immediately necessary for the preservation
296529 of the public peace, health or safety, an em ergency is hereby
297530 declared to exist, by reason whereof this act shall take effect and
298531 be in full force from and after its passage and approval.
