2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 59 O.S. 2021, Section 1750.3, is
3057 amended to read as follows:

3258 Section 1750.3. A. The director of the Council on Law
3359 Enforcement Education and Training, and any staff member designated
3460 by the director, shall h ave all the powers and authority of pe ace
3561 officers of this state for the purposes of enforcing the pro visions
3662 of the Oklahoma Security Guard and Private Investigator Act, and all
3763 other duties which are or may be conferred upon the Council by the
3864 Oklahoma Security Guard and Private Investigator Act. The powers

4093 by the director as a peace officer shall not limit the powers and
4194 duties of other peace officers of this state or any political
4295 subdivision thereof. The director, or any staff member appointed by
4396 the director as a peace officer shall, upon request, assist any
4497 federal, state, county, or municipal law enforcement agency.

4898 B. The Council on Law Enforcement Education and Training shall
4999 have the following powers and duties:

51100 1. To promulgate rules to carry out the purposes of the
52101 Oklahoma Security Guard and Private Investigator Act;
53-
54102 2. To establish and enforce standards governing the training of
55103 persons required to be licensed pursuant to t he Oklahoma Security
56104 Guard and Private Investigator Act with respect to:
57-
58105 a. issuing, denying, or revok ing certificates of approval
59106 to security training schools, and programs
60107 administered by the state, a county, a municipality, a
61108 private corporation, or an individual,
62-
63109 b. certifying instructors at approved security training
64110 schools,
65-
66111 c. establishing minimum r equirements for security
67112 training schools and periodically reviewing these
68113 standards, and
69-
70114 d. providing for periodic inspection of all security
71115 training schools or programs;

73143 3. To establish minimum curriculum requirements for training as
74144 the Council may require for security guards, armed security guards,
75145 and private investigators that shall include, but not be limited to ,
76146 recognizing and managing a person ap pearing to require mental health
77147 treatment or services, crisis intervention, and techniques to assist
78148 with de-escalating interactions between security guards, private
79149 investigators, and the public. Training requirements for unarmed
80150 security guards shall n ot exceed forty (40) hours of instruc tion;

82151 4. To establish minimum requirements for a mandatory cont inuing
83152 education program for all licensed private investigators and
84153 security guards which shall include, but not be limited to:
85-
86154 a. establishing a designate d minimum number of clock
87155 hours of required attendance, not to exceed twenty-
88156 four (24) clock hours du ring the licensing period, at
89157 accredited educational functions,

93158 b. establishing the penalties to be imposed upon a
94159 licensee for failure to comply with the continuing
95160 education requirements,

97161 c. designating the Priva te Security Advisory Committee to
98162 assist the Council in establishing the criteria for
99163 determining the qualifications of proposed continuing
100164 education programs that would be submitted to the
101165 Council for accreditation to meet this requi rement,

104194 d. providing that the expense of such continuing
105195 education shall be paid by the licensee participating
106196 therein;

108197 5. To grant a waiver of any training requirement, except
109198 firearms training which shall be requ ired for an armed security
110199 guard license, if the applicant has completed not less than one (1)
111200 year of full-time employment as a security guard, armed security
112201 guard, private investigator, or law enforcement officer within a
113202 three-year period immediately p receding the date of application and
114203 the applicant provides sufficient documentation thereof as may b e
115204 required by the Council;

117205 6. To grant an applicant credit for fulfilling any prescribed
118206 course or courses of training, including firearms training, upon
119207 submission of acceptable documentatio n of comparable traini ng. The
120208 Council may grant or refuse any s uch credit at its discretion;

122209 7. To issue the licenses and identification cards provided for
123210 in the Oklahoma Security Guard and Private Investigator Act;

125211 8. To investigate alleged violations of the Oklahoma Secur ity
126212 Guard and Private Investigator Act or rules relating thereto and to
127213 deny, suspend, or revoke licenses and identification cards if
128214 necessary, or to issue notices of reprimand to licensees with o r
129215 without probation under rules to be prescribed by the Cou ncil;

131216 9. To investigate alleged violation s of the Oklahoma Security
132217 Guard and Private Investigator Act by persons not licensed pursuant

135245 to such act and to impose administrative sanctions pursuant to rules
136246 or to seek an injunction pur suant to Section 1750. 2A of this title;

138247 10. To provide all form s for applications, identification
139248 cards, and licenses required by the Oklahoma Security Guard and
140249 Private Investigator Act;

142250 11. To enter into reciprocal agreements with officials of other
143251 states;

145252 12. To immediately suspend a license if a licensee 's actions
146253 present a danger to the licensee or to the public, a family
147254 household member, or involve a crime against a minor; and

149255 13. To require additional testin g for continuation or
150256 reinstatement of a license if a licen see exhibits an inability to
151257 exercise reasonable judgment, skill, or safety.
