An Act relating to the Oklahoma Capitol Improvemen t 
Authority; providing for allocation of funds from the 
Legacy Capital Financing Fund for purposes of 
constructing the State Capitol Arch; designating 
parcel of real property for purposes of construction; 
authorizing contract for design and construction; 
providing for applicability of provisions related to 
administration of the Legacy Capital Financing Fund; 
creating the State Capitol Arch Maintenance Revolving 
Fund; Stating purpose of fund; providing for the 
budgeting and expenditure of monies accrued and 
credited to the fund; providing for codification; 
providing an effective da te; and declaring an 
emergency. 
 
 
 
SUBJECT: Oklahoma Capitol Imp rovement Authority 
 
BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA: 
 
SECTION 1.     NEW LAW     A ne w section of law to be codified 
in the Oklahoma Statutes as Section 401 of Title 73, unless there is 
created a duplication in numbering, reads as follows:

A.  The Oklahoma Capitol Improvement Authority shall allocate 
the sum of Four Million Three Hundred Thousand Dollars 
($4,300,000.00) from the Legacy Capital Financing Fund for purposes 
of the design and construction of the State Capit ol Arch, the 
purpose of which is to honor and memorialize the services per formed 
by the Oklahoma National Guard. 
 
B.  The State Capitol Arch shall be constructed upon the 
following described parcel of real property: 
 
A tract of land lying in the No rtheast Quarter (NE/4) and the 
Northwest Quarter (NW/4) of Section Twenty -seven (27), Township 
Twelve (12) North, Range Three (3) West of the Indian Meridian, 
Oklahoma County, Oklahoma, being more particularly described as 
follows:  COMMENCING at the North west corner of the NE/4 of said 
Section 27; thence S00°07'01"E along the West line of said NE/4 a 
distance of 1436.71 feet to the POINT OF BEGINNING; thence 
N89°50'42"E a distance of 123.31 feet; thence S04°59'53"W a distance 
of 309.96 feet; thence S89°50' 42"W a distance of 194.19 feet; thence 
N05°20'12"W a distance of 309.98 feet; thence N89°50'42"E a distance 
of 126.71 feet to the POINT OF BEGINNING.  Containing 68,567.88 
Square Feet or 1.574 Acres, more or less. 
 
C.  The State Capitol Preservation Commission shall enter into 
contract with such person, persons, or lawfully recognized entities 
as may be required in order to construct the State Capitol Arch 
according to preliminary design documents as prepared by the 
Architect of the State Capitol. 
 
D.  The provisions of Section 187B of Title 73 of the Oklahoma 
Statutes shall be applicable to the project. 
 
SECTION 2.  There is hereby created in the State Treasury a 
revolving fund for the Office of Management and Enterprise Services 
to be designated the “State Capitol Arch Maintenance Revolving 
Fund”.  The fund shall be a continuing fund, not subject to fisc al 
year limitations, and shal l consist of all monies received by the 
Office of Management a nd Enterprise Services from appropriations, 
donations, gifts and bequests by individuals, corporations, 
organizations, associations and foundations provided for the purpose 
of maintenance of the State Capitol Arch.  All mon ies accruing to 
the credit of the fund are hereby appropriated and may be bu dgeted 
and expended by the Office of Management and Enterprise Services for 
the purpose provided for in this section.  Expenditures from the 
fund shall be made upon warrants issued by the State Treasurer  ENR. H. B. NO. 4012 	Page 3 
against claims filed as prescribed by law with the D irector of the 
Office of Management and Enterprise Services for approval and 
payment. 
 
SECTION 3.  This act shall become effective July 1, 2024. 
 
SECTION 4.  It being immediately n ecessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason wher eof this act shall take effect a nd 
be in full force from and after its passage and approval.  ENR. H. B. NO. 4012 	Page 4
