1749 An Act relating to the Student Athlete Name, Image
1850 and Likeness Rights Act; amending 70 O.S. 2021,
1951 Sections 820.23, as amended by Section 2, Chapter
2052 315, O.S.L. 2023, 820.25, as amended by Section 4,
2153 Chapter 315, O.S.L. 2023, and Section 6, Chapter 315,
2254 O.S.L. 2023 (70 O.S. Supp. 2023, Sections 820.23,
2355 820.25, and 820.27), which relate to compensation,

2557 collegiate athletic associations; removing
2658 prohibition for certa in compensation; authorizing

47103 SECTION 1. AMENDATORY 70 O.S. 2021, Section 820.23, as
48104 amended by Section 2, Chapter 315, O.S.L. 2023 (70 O.S. Supp. 2023,
49105 Section 820.23), is amended to read as follows:

51106 Section 820.23. A. Except as otherwise provided in the Student
52107 Athlete Name, Image and Likeness Rights Act, a student athlete may
53108 earn compensation for the use of the name, image, or likeness of the
54109 student athlete while enrolled at a postsecondary insti tution
55110 without penalty or re sulting limitation on participation.
56111 Compensation for the use of a student athlete’s name, image, or
57112 likeness shall not affect the student athlete’s eligibility for
58113 athletic grant-in-aid.

60114 B. A student athlete shall not earn compensation in exchange
61115 for his or her athletic performance or participation in
62116 intercollegiate athletics or sports competition. Compensa tion shall
63117 not be provided as an inducement for athletic performance or to
64118 attend or enroll at a particular institution .

66119 C. A postsecondary instit ution or an officer, director, or
67120 employee of such a third party authorized to act on behalf of the
68121 postsecondary institution shall not may provide professional
69122 representation or and compensate or cause compensation to be
70123 directed to a current or prospecti ve student athlete for his or her
71124 name, image, or likeness unless otherwise if permitted by a
72125 collegiate athletics association, of which the postsecondary
73126 institution is a member , and institutional policy.

75154 D. C. A collegiate athletic association shall not prohibit a
76155 postsecondary institution or a third party authorized to act on
77156 behalf of a postsecondary institu tion from identifying,
78157 facilitating, enabling, or supporting opportunities for a student
79158 athlete to earn compensation for the student athlete’s nam e, image,
80159 or likeness activities.

82160 E. D. The provisions of this section shall not be construed to
83161 qualify a student athlete as an employee of a postsecondary
84162 institution.

86163 SECTION 2. AMENDATORY 70 O.S. 2 021, Section 820.25, as
87164 amended by Section 4, Chapter 315, O.S.L. 2023 (70 O.S. Supp. 2023,

93167 postsecondary institution’s marks for the purpose of securing
94168 compensation for use of his or her name, image, or likeness unless
95169 authorized by the postsecondary institution.

97170 B. A student athlete sh all not enter into a name, image, and
98171 likeness agreement involving a commercial product or service that
99172 conflicts with a written policy of the post secondary institution or
100173 that negatively impacts or reflects adversely on the postsecondary
101174 institution or its athletic programs including, but not limited to,
102175 generating public disrepute, embarrassment, scandal, ridicule or
103176 otherwise negatively impacting the reputation or the moral or
104177 ethical standards of the postsecondary institution.

106205 C. A contract for the use of a student athlete’s name, image,
107206 or likeness or a contract for professional representation related to
108207 name, image, or likeness that is formed w hile the student athlete is
109208 participating in an intercollegiate sport at a postsecondary
110209 educational institution may not extend beyond the student athlete’s
111210 participation in the sport at the institution unless the contract is
112211 between the student athlete an d the postsecondary institution or a
113212 third party authorized to act on behalf of the postsecondary
114213 institution.

116214 D. A postsecondary institution may adopt reasonable time,
117215 place, and manner restrictions to prevent a student athlet e’s name,
118216 image, or likeness activities from interfering with team activities,
119217 the postsecondary institution’s operations, or the use of the
120218 institution’s facilities. A postsecondary institution may receive
121219 compensation for the use of its institutional marks or facilities in
122220 conjunction with a student athlete’s name, image, and likeness
123221 activities.

125222 E. A collegiate athletic association sha ll not prohibit a
126223 postsecondary institution from establishing agreements with a third-
127224 party entity third party to act on its behalf to identify,
128225 facilitate, enable, or support student athlete name, image, and
129226 likeness activities.

131227 F. An institution may req uire a student athlete to take courses
132228 or receive education or training in contracts, financial literacy,

139259 SECTION 3. AMENDATORY Section 6, Chapter 315, O.S.L.

143262 Section 820.27. A. A collegiate athletic association shall not

146264 1. Prevent a student athlete at a postsecondary institution
147265 from earning compensation from for the use of his or her name,

150267 2. Provide a prospective student athlete with compensation in
151268 relation to the use of his or her name , image, or likeness;

153269 3. Penalize a student athlete or prevent a student athlete from
154270 full participation in an interco llegiate sport because he or she
155271 obtains professional representation or receives assistance with
156272 services associated with name, image, or likeness activities
157273 including with contracts or other legal matters from an individual,
158274 entity, or a postsecondary institution; or

160275 4. 3. Allow compensation earned by a student athlete for the
161276 use of his or her name, image, or likeness or athletic reputat ion to
162277 affect the amount, duration, or renewal of or eligibility for any
163278 athletic grant-in-aid or other institutional s cholarship; provided,
164279 however, compensation earned by a student athlete for the use of his

169310 B. A collegiate athletic association shall not and shall not
170311 authorize its member institutions to:

172312 1. Prevent a postsecondary institution from p articipation in
173313 intercollegiate athletics because a student athlete in attendance
174314 has previously earned or intends to e arn compensation for the use of
175315 his or her name, image, or likeness;

179316 2. Entertain a complaint, open an investigation, or take any
180317 other adverse action against a postsecondary institution or an
181318 employee or student athlete of a postsecondary institution for
182319 engaging in any activity pr otected in the Student Athlete Name,
183320 Image and Likeness Rights Act or for involvement in student athlete
184321 name, image, or likeness activities; or

186322 3. Penalize a postsecondary institution from participation in
187323 intercollegiate athl etics or an employee or stud ent athlete of a
188324 postsecondary institution because an individual or entity whose
189325 purpose includes supporting or benefitting the postsecondary
190326 institution or its athletic programs violates the collegiate
191327 athletic association’s rules or regulations with rega rd to student
192328 athlete name, image, or likeness activities.

194329 C. No postsecondary institution’s officers or employees,
195330 including athletics coaching staff, shall be liable for any damages

201362 SECTION 4. AMENDATORY 70 O.S. 2021, Section 822.2, is

204364 Section 822.2. A. Except as provided for in subsection C of
205365 this section, no person shall give, offer, promise or a ttempt to
206366 give any money or other thing of value to a student-athlete student
207367 athlete or member of the immediate family of a student-athlete
208368 student athlete:

210369 1. To induce, encourage or reward the application, enrollment
211370 or attendance of the student-athlete student athlete at a public or
212371 private institution of postsecondary education in order to have the
213372 student-athlete student athlete participate in intercollegiate
214373 sporting events, contests, exhibitions or programs at that
215374 institution; or

217375 2. To induce, encourage or reward the participation in an
218376 intercollegiate sporting event, contest, exhibition or program by
219377 the student-athlete student athlete.

224379 agent a transaction with a student-athlete student athlete if the
225380 person has, or could be reasonably expected to have, knowledge that

227409 athlete to permanently or temporarily lose athletic scholarship
228410 eligibility, the ability to participate o n an intercollegiate
229411 athletic team or the ability to participate in one or more
230412 intercollegiate sporting competitions a s sanctioned by:

232413 1. A national collegiate athletic association for the promotion
233414 and regulation of intercollegiate athletics as defined in the
234415 Student Athlete Name, Image and Likeness Act ;
235-
236416 2. An athletic conference or Any other sanctioning body; or
237-
238417 3. The institution of postsecond ary education itself as a
239418 reasonable self-imposed disciplinary action taken by the institution
240419 to mitigate sanctions likely to be imposed by an organization as a
241420 result of the transaction or as a violation of the rules of the
242421 institution.

244422 C. This section shall not apply to:

246423 1. Any public or private institution of postsecondary education
247424 or to any officer or emp loyee of the institution when the
248425 institution or the officer or employee of the institution is acting
249426 in accordance with an official written policy of the postsecondary
250427 institution which is in compliance with the bylaws of the National
251428 Collegiate Athletic Association;

253429 2. Any intercollegiate athletic award approved or administered
254430 by the public or private institution of po stsecondary education;

264464 athlete student athlete or the immediate family of a student-athlete

268466 value in the aggregate on an ann ual basis; and

270467 6. A gift, offer, promise, or attempt to give money or other
271468 thing of value given by a person to a student athlete or member of
272469 the immediate family of a student athlete if such gift, offer,
273470 promise, or attempt conforms with the rules of any collegiate
274471 athletic association of which the postsecondary institution is a
275472 member.

277473 D. Any person who violates the provisions of this section shall
278474 be guilty of a misdemeanor and, upon conviction, shall be subject to
279475 a fine of not less than One Thousand Dollars ($1,000.00) and not
280476 more than Five Thousand Dollars ($5,000.00), or by imprisonment not
281477 to exceed one (1) year, or by both such fine and imprisonment.

283478 SECTION 5. It being immediately necessary for the preservation
284479 of the public peace, health or safety, an em ergency is hereby
