140244 Section 420. A. A person in possess ion of a state-issued
141245 medical marijuana patient license shall be able to:

143246 1. Consume marijuana legally;

145247 2. Legally possess up to three (3) ounces or eighty -four and
146248 nine-tenths (84.9) grams of marijuana on their person;

148249 3. Legally possess six mature mar ijuana plants and the
149250 harvested marijuana therefrom;

153252 5. Legally possess o ne (1) ounce or twenty -eight and three-
154253 tenths (28.3) grams of conc entrated marijuana;

156254 6. Legally possess seventy -two (72) ounces or two thou sand
157255 thirty-seven and six-tenths (2,037.6) grams of edible marijuana;

159256 7. Legally possess up to eight (8) ounces or two hundred
160257 twenty-six and four-tenths (226.4) grams of marijuana in their
161258 residence; and

163259 8. Legally possess seventy -two (72) ounces of top ical
164260 marijuana.

166261 B. Possession of up to one and one -half (1.5) ounces or forty -
167262 two and forty-five one-hundredths (42.45) grams of marijuana by
168263 persons who can state a medical condit ion, but are not in possession
169264 of a state-issued medical marijuana patient license, shall
170265 constitute a misdemeanor offense not subject to imprisonment but
171266 punishable by a fine not to exceed Four Hundred Dollars ($400.00).

173294 violation of this subsection and who is sa tisfied as to the identity
174295 of the person, as well as any other pertinent information the law
175296 enforcement officer de ems necessary, shall issue to the person a
176297 written citation contai ning a notice to answer the charge against
177298 the person in the appropriate co urt. Upon receiving the written

180299 promise of the alleged violator to answer as specified in the
181300 citation, the law en forcement officer shall release the person upon
182301 personal recognizance unless there has been a violation of another
183302 provision of law.

185303 C. The Oklahoma Medical Marijuana Authority shall be
186304 established which shall receive applications for medical marijuana
187305 patient and caregiver license recipients, dispensaries, growers and
188306 processors within sixty (60) days of the passage of this initiative.
189-
190307 D. The Authority shall, within thirty (30) days of passage of
191308 this initiative, make available on its website, in an easy -to-find
192309 location, an application for a medical marijuana patient license.
193310 The license shall be valid for two (2) years. The biannual
194311 application fee shall be One Hundred Dollars ($100.00), or Twenty
195312 Dollars ($20.00) for individuals on Medicaid, Medicare or SoonerCare
196313 or one hundred percent (100%) disabled veterans. The methods of
197314 payment shall be provided on the website of the Authority. R eprints
198315 of the medical marijuana patient license shall be Twenty Dol lars

201343 E. A short-term medical marijua na patient license application
202344 shall also be made available on the website of the Authority. A
203345 short-term medical marijuana patient license shall be granted to any
204346 applicant who can meet the requirements for a two-year medical
205347 marijuana patient license, b ut whose physician recommendation for
206348 medical marijuana is only va lid for sixty (60) days. Short -term
207349 medical marijuana patient licenses sha ll be issued for sixty (60)
208350 days. The fee for a short -term medical marijuana patient license,
209351 reprints of the shor t-term medical marijuana patient license and the
210352 procedure for extending or renewing the license shall be determined
211353 by the Executive Directo r of the Authority.

213354 F. A temporary medical marijuana patient licens e application
214355 shall also be available on the we bsite of the Authority for
215356 residents of other states. Temporary m edical marijuana patient
216357 licenses shall be granted to medical marijuana lic ense holders from
217358 other states, provided that such states have state -regulated medical
218359 marijuana programs and appli cants can prove they are members of such
219360 programs. Temporary medi cal marijuana patient licenses shall be
220361 issued for thirty (30) days. The c ost for a temporary medical
221362 marijuana patient license shall be One H undred Dollars ($100.00).

224363 Renewal shall be gra nted with resubmission of a new application. No
225364 additional criteria shall be required. Reprints of the temporary
226365 medical marijuana patient license shall be Twenty Dollars ($20.00).

228392 G. Medical marijuana pati ent license applicants shall submit
229393 their applications to the Authority for approval. The applicant
230394 shall be a resident of this state and shall prove residency by a
231395 valid driver license, utility bills, or other accepted methods.

233396 H. The Authority shall re view the medical marijuana patient
234397 license application; approve, reject or deny the application; and
235398 mail the approval, rejection or denial letter stating any reasons
236399 for the rejection or denial to the applicant within fourteen (14)
237400 business days of receip t of the application. Approved applicants
238401 shall be issued a medical marijuana patient license which shall act
239402 as proof of his or her approved status. Applications may only be
240403 rejected or denied based on the applicant not meeting stated
241404 criteria or improper completion of the application.

243405 I. The Authority shall make available, both on its website and
244406 through a telephone verification system, an easy method to validate
245407 the authenticity of th e medical marijuana patient license by the
246408 unique 24-character identification number.
247-
248409 J. The Authority shall ensur e that all medical marijuana
249410 patient and caregiver records and inf ormation are sealed to protect
250411 the privacy of medical marijuana patient lic ense applicants.
251-
252412 K. A caregiver license shall be made available for qualified
253413 caregivers of a medical marijuana pa tient license holder who is
254414 homebound. As provided in Section 427 .11 of this title, the
255415 caregiver license shall provide the caregiver the sa me rights as the

256442 medical marijuana patient licensee including the ab ility to possess
257443 marijuana, marijuana products and mature and immature plants
258444 pursuant to the Oklahoma Medical Ma rijuana and Patient Protection
259445 Act, but excluding the ability to use mariju ana or marijuana
260446 products unless the caregiver has a medical marijua na patient
261447 license. Applicants for a caregiver license shall submit proof of
262448 the license status and homebound st atus of the medical marijuana
263449 patient and proof that the applicant is the d esignee of the medical
264450 marijuana patient. The applicant shall also submit proof that he or

267451 she is eighteen (18) ye ars of age or older and proof of his or her
268452 state residency.

270453 L. All applicants for a medical marijuana patient license shall
271454 be eighteen (18) years of age or older. A special exception shall
272455 be granted to an applicant under the age of eighteen (18); howe ver,
273456 these applications shall be signed by two physicians and the parent
274457 or legal guardian of the applicant . The two physicians shall not be
275458 located at the same physical address. At least one of the
276459 physicians shall attest that the minor applicant has be en under the
277460 routine care of the physician for not less than one ( 1) year, or not
278461 less than five (5) years if the minor patient has only been seen by
279462 the physician through telemedicine, or that the minor appli cant was
280463 referred to the physician by a physici an whose care the minor
281464 applicant has been under for not less than one (1) year or not less

285493 M. All applications for a medical marijuana patient license
286494 shall be signed by an Oklahoma a physician located in this state and
287495 licensed by and in good standing with the State Board of Medical
288496 Licensure and Supervision, the State Board of Osteopathic Examiners,
289497 or the Board of Podiatric Medical Examiners. There are n o
290498 qualifying conditions for patients eighteen (18) years of age or
291499 older, unless the patient is currently enrolled in a public school
292500 in this state. The Executive Director shall consult with
293501 appropriate medical licensure boards or organization s representing
294502 healthcare providers that oversee the care of pediatric patient s in
295503 this state to promulgate rules to specify qualifying medical
296504 conditions for a medical marijuana patient under eighteen (18) years
297505 of age, or for patients eighteen (18) years of ag e or older who are
298506 currently enrolled in a publ ic school in this state, for licensure.
299507 A medical marijuana patient license shall be recommend ed according
300508 to the accepted standards a reasonable and prudent physician would
301509 follow when recommending or approving an y medication, and may only
302510 be recommended for qu alifying medical conditions approved by the
303511 Executive Director for patients under eighteen (18) years of age, or
304512 who are currently enrolled in a publ ic school in this state. Before
305513 issuing a medical marijuan a recommendation to a minor patient, a
306514 physician shall first condu ct an in-person examination of the

308542 homebound and in need of a caregi ver under subsection K of this

312544 signing a medical marijuana pat ient license application.

314545 N. Counties and cities may enact medical marijuana guidelines
315546 allowing medical marijuana patient licen se holders or caregiver
316547 license holders to exceed the state l imits set forth in subsection A
317548 of this section.

319549 SECTION 2. AMENDATORY 63 O.S. 2021, Section 421, as
320550 amended by Section 1, Chapter 332, O.S.L. 2022 (63 O.S. Supp. 2022,
321551 Section 421), is amended to read as follows:

323552 Section 421. A. The Oklahoma Medical Marijuana Authority shall
324553 make available on its website in an easy-to-find location an
325554 application applications for a temporary medical marijuana
326555 dispensary license and annual medical marijuana dispensary license.
327556 The application fee to fees for the temporary or annual license
328557 shall be paid by the applicant shall be in the amounts provided for
329558 in Section 427.14 of this title. A method of payment for the
330559 application fee fees shall be provided on the website of the
331560 Authority. Dispensary Medical marijuana dispensary applicants must
332561 all be residents of Oklahoma. Any entity applying for a temporary
333562 or annual medical marijuana dispensary license must be owned by an
334563 Oklahoma resident and must be registere d to do business in Oklahoma.

337592 approve, reject or deny the application; and mail the approval,
338593 rejection or denial letter stating reasons for the rejection or
339594 denial to the applicant.

341595 B. The In addition to the requirements provided for in the
342596 Oklahoma Medical Marijuana and Patient Protection Act, the Authority
343597 shall approve all applications which meet the following criteria:
344-
345598 1. The applicant must be twenty-five (25) years of age or
346599 older;
347-
348600 2. The applicant, if applying as an individual, must show
349601 residency in the State of Oklahoma;
350-
351602 3. All applying entities must show that a ll members, managers,
352603 and board members are Oklahoma residents;

356604 4. An applying entity may show ownership of non-Oklahoma
357605 residents, but that percentage ownership may not exceed twenty-five
358606 percent (25%);

360607 5. All applying individuals or entities must be registered to
361608 conduct business in the State of Oklahoma; and

363609 6. All applicants must disclose all ownership interests in the
364610 dispensary.

366611 Applicants with a nonviolent felony conviction in the last two
367612 (2) years, any other felony conviction i n the last five (5) years,
368613 inmates in the custody of the Department of Corrections or any

369640 person currently incarcerated shall not qualify for a temporary or
370641 annual medical marijuana dispensary license.

372642 C. Licensed medical marijuana dispensaries shall be required to
373643 complete a monthly sal es report to the Authority. This report shall
374644 be due on the fifteenth of each month and provide reporting on the
375645 previous month. This report shall detail the weight of marijuana
376646 purchased at wholesale and the weight of marijuan a sold to licensed
377647 medical marijuana patients and licensed caregivers and account for
378648 any waste. The report shall show total sales in dollars, tax
379649 collected in dollars, and tax due in dollars. The Authority shall
380650 have oversight and auditing responsibilities to ensure that all
381651 marijuana being grown is accounted for.

383652 D. Only a licensed medical marijuan a dispensary may conduct
384653 retail sales of marijuana or marijuana derivatives. Beginning on
385654 the effective date of this act, licens ed medical marijuana
386655 dispensaries shall be authorized to package and sell pre-rolled
387656 marijuana to licensed medical marijuana pa tients and licensed
388657 caregivers. The products described in this subsection shall contain
389658 only the ground parts of the marijuana p lant and shall not include
390659 marijuana concentrates or der ivatives. The total net weight of each
391660 pre-roll packaged and sold by a medical marijuana dispensary shall
392661 not exceed one (1) gram. These products shall be tested, packaged
393662 and labeled in accordance with Oklahoma law and rules promulgated by
394663 the Authority.

398690 E. No medical marijuana dispensary shall offer or allow a
399691 medical marijuana patient licensee, caregiver licensee or other
400692 member of the public to handle or otherwise have physical contact
401693 with any medical marijuana not contained in a sealed or separate
402694 package. Provided, such prohibition shall not preclude an employee
403695 of the medical marijuana dispensary from handling loose or
404696 nonpackaged medical marijuana to be placed in packaging consistent
405697 with the Oklahoma Medical Marijuana and Patient Protection Act and
406698 the rules promulgated by the Authority for the packaging of medical
407699 marijuana for retail sale. Provided, further, such prohibition
408700 shall not prevent a medical marijuana dispensary from displaying
409701 samples of its medical marijuana in separate display c ases, jars or
410702 other containers and allowing medical marijuana patient licensees
411703 and caregiver licensees the ability to handle or smell the various
412704 samples as long as the sample medical marijuana is used for display
413705 purposes only and is not offered for reta il sale.

468799 shall not be subject to taxation. Under no circumstances may a
469800 licensed medical marijuana commercial grower sell marijuana directly
470801 to a licensed medical marijuana patient or licensed medical
471802 marijuana caregiver. A licensed medical marijuana commercial grower
472803 may only sell at the wholesale level to a licensed medical marijuana
473804 dispensary, a licensed medical marijuana commercial grower or a
474805 licensed medical marijuana processor. If the federal government
475806 lifts restrictions on buying and selli ng marijuana between states,
476807 then a licensed medical marijuana commercial grower would be allowed
477808 to sell and buy marijuana wholesale from, or to, a n out-of-state
478809 wholesale provider. A licensed medical marijuana commercial grower
479810 shall be required to complete a monthly yield and sales report to
480811 the Authority. This report shall be due on the fifteenth of each

493847 D. There shall be no limits on how much marijuana a licensed
494848 medical marijuana commercial grower can grow.

496849 E. Beginning on the effective date of this act, licensed
497850 medical marijuana commercial growers shall be authorized to package
498851 and sell pre-rolled marijuana to licensed medical marijuana
499852 dispensaries. The products described in this subsection shall
500853 contain only the ground parts of the marijuana plant and shall not
501854 include marijuana concentrates or derivatives. The total net weight
502855 of each pre-roll packaged and sold by licensed medical marijuana
503856 commercial growers shall not exceed one (1) gram. These products
504857 must be tested, packaged and labeled in accordance with Oklahoma law
505858 and rules promulgated by the Authority.

6221053 A signed letter of twenty operating, licensed medical marijuana
6231054 processors shall constitute a need for a new council and standards

11061843 psychotropic cannabinoid in marijuana formed by decarboxylation of
11071844 naturally tetrahydrocannabinolic acid, which generally occurs by

11101846 64. “Test batch” means with regard to usable marijuana, a
11111847 homogenous, identified quantity of usable marijuana by strain, no
11121848 greater than ten (10) pounds, that is harvested during a seven-day

11141850 vapors and waxes derived from usable marijuana, means an identifie d
11151851 quantity that is uniform, that is intended to meet specifications

26944416 B. Every applicant for a commercial grower license or
26954417 commercial grower licensee shal l file with the Oklahoma Medical
26964418 Marijuana Authority a bond satisfactory to the Authority and in the
26974419 amount no less than Fifty Thousand Dollars ($50,000.00) for each
26984420 license sought or held, with a surety company qualified to do
26994421 business in this state as a surety. The bond shall be furnished to
27004422 the state for the use of the state pursuant to the provisions of
27014423 this act. The bond shall be conditional that the obligor will
27024424 comply with the provisions of this act including, but not limited
27034425 to, building codes, ad ministrative rules, and other relevant l aws,
27044426 and all rules and regulations made pursuant to this act and will pay
27054427 all amounts of money that may be due to the state during the time
27064428 such bond is in effect.

27084429 C. The Authority or the Department of Environmental Quality may
27094430 require a higher amount dep ending upon the reclamation requirements
27104431 of the approved application. The amount shall reflect the probable

27214465 D. An appropriate agency may recall the bond if the property
27224466 has been abandoned, the Authority revokes the commercial growing
27234467 operation’s license, or in response to receiving notice of a
27244468 violation of any law, regula tion, policy, or ordinance necessitating
27254469 remedial action. The bond shall be used to defray the cost of
27264470 restoration of the property including, but not limited to, removing
27274471 equipment, destruction of waste, remediation of environmental
27284472 hazards, prohibiting p ublic access, addressing improperly code d
27294473 buildings, or determination of the final disposition of any seized
27304474 property.

27324475 E. A holder of a medical marijuana business license pursuant to
27334476 Section 427.14 of Title 63 of the Oklahoma Statutes this title
27344477 engaging in a commercial growing operation may op erate without
27354478 obtaining a bond upon verification by the Authority that the
27364479 permitted land on which the licensee operates the commercial growing
27374480 operation has been owned by the licensee for at least a five -year
27384481 period prior to submission of application.

27404482 F. The Authority shall promulgate the rules necessary to allow
27414483 for a medical marijuana business licensee to engage in a commercial
27424484 growing operation to fulfill the provisions of this section.
