12	6		AN ACT
13	7		relating to the review date for certain governmental entities
14	8		subject to the sunset review process.
15	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
16	10		SECTION 1. Section 11.003, Agriculture Code, is amended to
17	11		read as follows:
18	12		Sec. 11.003. SUNSET PROVISION. The Department of
19	13		Agriculture is subject to Chapter 325, Government Code (Texas
20	14		Sunset Act). Unless continued in existence as provided by that
21	15		chapter, the department is abolished September 1, 2023 [2021].
22	16		SECTION 2. Section 74.127(a), Agriculture Code, is amended
23	17		to read as follows:
24	18		(a) The board of directors of the official cotton growers'
25	19		boll weevil eradication foundation is subject to Chapter 325,
26	20		Government Code (Texas Sunset Act). Unless continued in existence
27	21		as provided by that chapter, the board is abolished and this
28	22		subchapter expires September 1, 2023 [2021].
29	23		SECTION 3. Section 161.027, Agriculture Code, is amended to
30	24		read as follows:
31	25		Sec. 161.027. SUNSET PROVISION. The Texas Animal Health
32	26		Commission is subject to Chapter 325, Government Code (Texas Sunset
33	27		Act). Unless continued in existence as provided by that chapter,
34	28		the commission is abolished September 1, 2023 [2021].
35	29		SECTION 4. Section 54.603, Education Code, is amended to
36	30		read as follows:
37	31		Sec. 54.603. SUNSET PROVISION. The Prepaid Higher
38	32		Education Tuition Board is subject to Chapter 325, Government Code
39	33		(Texas Sunset Act). Unless continued in existence as provided by
40	34		that chapter, the board is abolished and the programs established
41	35		under this subchapter and under Subchapters G and H terminate
42	36		September 1, 2023 [2021].
43	37		SECTION 5. Section 15.212, Finance Code, is amended to read
44	38		as follows:
45	39		Sec. 15.212. SUNSET PROVISION. The Credit Union Department
46	40		and the Credit Union Commission are subject to Chapter 325,
47	41		Government Code (Texas Sunset Act). Unless continued in existence
48	42		as provided by that chapter, the department and commission are
49	43		abolished September 1, 2023 [2021].
50	44		SECTION 6. Section 419.003, Government Code, is amended to
51	45		read as follows:
52	46		Sec. 419.003. SUNSET PROVISION. The Texas Commission on
53	47		Fire Protection is subject to Chapter 325 (Texas Sunset Act).
54	48		Unless continued in existence as provided by that chapter, the
55	49		commission is abolished and this chapter expires September 1, 2023
56	50		[2021].
57	51		SECTION 7. Section 449.002, Government Code, is amended to
58	52		read as follows:
59	53		Sec. 449.002. SUNSET PROVISION. The Texas Holocaust and
60	54		Genocide Commission is subject to Chapter 325 (Texas Sunset Act).
61	55		Unless continued in existence as provided by that chapter, the
62	56		commission is abolished and this chapter expires September 1, 2023
63	57		[2021].
64	58		SECTION 8. Section 481.003, Government Code, is amended to
65	59		read as follows:
66	60		Sec. 481.003. SUNSET PROVISION. The Texas Economic
67	61		Development and Tourism Office is subject to Chapter 325 (Texas
68	62		Sunset Act). Unless continued in existence as provided by that
69	63		chapter, the office is abolished and this chapter expires September
70	64		1, 2023 [2021].
71	65		SECTION 9. Section 511.003, Government Code, is amended to
72	66		read as follows:
73	67		Sec. 511.003. SUNSET PROVISION. The Commission on Jail
74	68		Standards is subject to Chapter 325 (Texas Sunset Act). Unless
75	69		continued in existence as provided by that chapter, the commission
76	70		is abolished and this chapter expires September 1, 2023 [2021].
77	71		SECTION 10. Section 751.003, Government Code, is amended to
78	72		read as follows:
79	73		Sec. 751.003. SUNSET PROVISION. The Office of
80	74		State-Federal Relations is subject to Chapter 325 (Texas Sunset
81	75		Act). Unless continued in existence as provided by that chapter,
82	76		the office is abolished and this chapter expires September 1, 2023
83	77		[2021].
84	78		SECTION 11. Section 825.006, Government Code, is amended to
85	79		read as follows:
86	80		Sec. 825.006. SUNSET PROVISION. The board of trustees of
87	81		the Teacher Retirement System of Texas is subject to review under
88	82		Chapter 325 (Texas Sunset Act), but is not abolished under that
89	83		chapter. The board shall be reviewed during the period in which
90	84		state agencies abolished in 2023 [2021], and every 12th year after
91	85		that year, are reviewed.
92	86		SECTION 12. Section 691.003, Health and Safety Code, is
93	87		amended to read as follows:
94	88		Sec. 691.003. SUNSET PROVISION. The Anatomical Board of
95	89		the State of Texas is subject to Chapter 325, Government Code (Texas
96	90		Sunset Act). Unless continued in existence as provided by that
97	91		chapter, the board is abolished September 1, 2023 [2021].
98	92		SECTION 13. Section 51.002(a), Occupations Code, is amended
99	93		to read as follows:
100	94		(a) The Texas Commission of Licensing and Regulation and the
101	95		Texas Department of Licensing and Regulation are subject to Chapter
102	96		325, Government Code (Texas Sunset Act). Unless continued in
103	97		existence as provided by that chapter, the commission and the
104	98		department are abolished September 1, 2023 [2021].
105	99		SECTION 14. Section 801.003, Occupations Code, is amended
106	100		to read as follows:
107	101		Sec. 801.003. APPLICATION OF SUNSET ACT. The State Board of
108	102		Veterinary Medical Examiners is subject to Chapter 325, Government
109	103		Code (Texas Sunset Act). Unless continued in existence as provided
110	104		by that chapter, the board is abolished and this chapter expires
111	105		September 1, 2023 [2021].
112	106		SECTION 15. Section 1701.002, Occupations Code, is amended
113	107		to read as follows:
114	108		Sec. 1701.002. APPLICATION OF SUNSET ACT. The Texas
115	109		Commission on Law Enforcement is subject to Chapter 325, Government
116	110		Code (Texas Sunset Act). Unless continued in existence as provided
117	111		by that chapter, the commission is abolished and this chapter
118	112		expires September 1, 2023 [2021].
119	113		SECTION 16. Section 2021.008(a), Occupations Code, is
120	114		amended to read as follows:
121	115		(a) The commission is subject to Chapter 325, Government
122	116		Code (Texas Sunset Act). Unless continued in existence as provided
123	117		by that chapter, and except as provided by Subsections (b) and (c),
124	118		the commission is abolished and this subtitle expires September 1,
125	119		2023 [2021].
126	120		SECTION 17. Section 11.0111, Parks and Wildlife Code, is
127	121		amended to read as follows:
128	122		Sec. 11.0111. SUNSET PROVISION. The Parks and Wildlife
129	123		Department is subject to Chapter 325, Government Code (Texas Sunset
130	124		Act). Unless continued in existence as provided by that chapter,
131	125		the department is abolished September 1, 2023 [2021].
132	126		SECTION 18. Section 8502.0021(a), Special District Local
133	127		Laws Code, is amended to read as follows:
134	128		(a) The authority is subject to review under Chapter 325,
135	129		Government Code (Texas Sunset Act), but may not be abolished under
136	130		that chapter. The review shall be conducted under Section 325.025,
137	131		Government Code, as if the authority were a state agency scheduled
138	132		to be abolished September 1, 2023 [2021], and every 12th year after
139	133		that year.
140	134		SECTION 19. If a conflict exists between this Act and
141	135		another Act of the 87th Legislature, Regular Session, 2021, that
142		-	~~amends or repeals~~ the sunset date of a governmental entity, the
143		-	~~provisions of~~ the other Act control without regard to the relative
144		-	~~dates of~~ enactment.

145	139		SECTION 20. This Act takes effect immediately if it
146	140		receives a vote of two-thirds of all the members elected to each

149	143		effect, this Act takes effect September 1, 2021.
