| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Section 331.001(3), Health and Safety Code, is |
|---|
| 11 | 13 | | amended to read as follows: |
|---|
| 12 | 14 | | (3) "Facility" means: |
|---|
| 13 | 15 | | (A) a home and community support services agency |
|---|
| 14 | 16 | | licensed or licensed and certified under Chapter 142 [to provide |
|---|
| 15 | 17 | | home health services as defined by Section 142.001] that employs at |
|---|
| 16 | 18 | | least two registered nurses; |
|---|
| 17 | 19 | | (B) a hospital licensed under Chapter 241 and a |
|---|
| 18 | 20 | | hospital maintained or operated by an agency of this state that is |
|---|
| 19 | 21 | | exempt from licensing under that chapter; |
|---|
| 20 | 22 | | (C) a nursing facility licensed under Chapter 242 |
|---|
| 21 | 23 | | that employs at least two registered nurses; |
|---|
| 22 | 24 | | (D) an ambulatory surgical center licensed under |
|---|
| 23 | 25 | | Chapter 243; |
|---|
| 24 | 26 | | (E) a freestanding emergency medical care |
|---|
| 25 | 27 | | facility as defined by Section 254.001; [and] |
|---|
| 26 | 28 | | (F) a mental hospital licensed under Chapter 577; |
|---|
| 27 | 29 | | (G) an intermediate care facility for |
|---|
| 28 | 30 | | individuals with an intellectual disability licensed under Chapter |
|---|
| 29 | 31 | | 252; and |
|---|
| 30 | 32 | | (H) a state supported living center as defined by |
|---|
| 31 | 33 | | Section 531.002. |
|---|
| 32 | 34 | | SECTION 2. Not later than September 1, 2026, a home and |
|---|
| 33 | 35 | | community support services agency, intermediate care facility for |
|---|
| 34 | 36 | | individuals with an intellectual disability, or state supported |
|---|
| 35 | 37 | | living center that becomes subject to Chapter 331, Health and |
|---|
| 36 | 38 | | Safety Code, under Section 331.001, Health and Safety Code, as |
|---|
| 37 | 39 | | amended by this Act, shall comply with the requirements of that |
|---|
| 38 | 40 | | chapter. |
|---|
| 39 | 41 | | SECTION 3. This Act takes effect September 1, 2025. |
