1011 Be it enacted by the General Assembly of the State of Missouri, as follows:
11-SectionA.Chapter196,RSMo,isamendedbyaddingtheretoonenewsection,tobe

13-196.1170.1.Thissectionshallbeknownandmaybecitedasthe"Kratom
14-2ConsumerProtectionAct".
15-3 2.Asusedinthissection,thefollowingtermsmean:
16-4 (1)"Dealer",apersonwhosells,prepares,ormaintainskratomproductsor
17-5advertises,represents,orholdsoneselfoutasselling,preparing,ormaintainingkratom
18-6products.Suchpersonmayinclude,butnotbelimitedto,amanufacturer,wholesaler,
19-7store,restaurant,hotel,cateringfacility,camp,bakery,delicatessen,supermarket,
20-8grocerystore,conveniencestore,nursinghome,orfoodordrinkcompany;

78-65placementofthedisclosurelabelrequiredpursuanttosubdivision(1)ofsubsection4of
79-66thissectionandfortheinformationtobeincludedinthedisclosurelabel.Anyruleor
80-67portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe
81-68authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
82-69subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This
83-70sectionandchapter536arenonseverable,andifanyofthepowersvestedwiththe
84-71generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
85-72disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
86-73rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2022,shallbe
87-74invalidandvoid.

12+ Section A. Chapter 196, RSMo, is amended by adding thereto 1
13+one new section, to be known as section 196.1170, to read as 2
14+follows:3
15+ 196.1170. 1. This section shall be known and may be 1
16+cited as the "Kratom Consumer Protection Act". 2
17+ 2. As used in this section, the following terms mean: 3
18+ (1) "Dealer", a person who sells, prepares, or 4
19+maintains kratom products or advertises, re presents, or 5
20+holds oneself out as selling, preparing, or maintaining 6
21+kratom products. Such person may include, but not be 7
22+limited to, a manufacturer, wholesaler, store, restaurant, 8
23+hotel, catering facility, camp, bakery, delicatessen, 9
24+supermarket, grocery store, convenience store, nursing home, 10
25+or food or drink company; 11
26+ (2) "Department", the department of health and senior 12
27+services; 13
28+ (3) "Director", the director of the department or the 14
29+director's designee; 15
30+ (4) "Food", a food, food product, food ingredient, 16
31+dietary ingredient, dietary supplement, or beverage for 17
32+human consumption; 18
33+ (5) "Kratom product", a food product or dietary 19
34+ingredient containing any part of the leaf of the plant 20
35+Mitragyna speciosa. 21

37+ 3. The general assembly hereby occupies and preempts 22
38+the entire field of regulating kratom products to the 23
39+complete exclusion of any order, ordinance, or regulation of 24
40+any political subdivision of this state. Any political 25
41+subdivision's existing or future orders, o rdinances, or 26
42+regulations relating to kratom products are hereby void. 27
43+ 4. (1) A dealer who prepares, distributes, sells, or 28
44+exposes for sale a food that is represented to be a kratom 29
45+product shall disclose on the product label the factual 30
46+basis upon which that representation is made. 31
47+ (2) A dealer shall not prepare, distribute, sell, or 32
48+expose for sale a food represented to be a kratom product 33
49+that does not conform to the disclosure requirement under 34
50+subdivision (1) of this subsection. 35
51+ 5. A dealer shall not prepare, distribute, sell, or 36
52+expose for sale any of the following: 37
53+ (1) A kratom product that is adulterated with a 38
54+dangerous non-kratom substance. A kratom product shall be 39
55+considered to be adulterated with a dangerous non-kratom 40
56+substance if the kratom product is mixed or packed with a 41
57+non-kratom substance and that substance affects the quality 42
58+or strength of the kratom product to such a degree as to 43
59+render the kratom product injurious to a consumer; 44
60+ (2) A kratom product that is contaminated with a 45
61+dangerous non-kratom substance. A kratom product shall be 46
62+considered to be contaminated with a dangerous non -kratom 47
63+substance if the kratom product contains a poisonous or 48
64+otherwise deleterious non -kratom ingredient including, but 49
65+not limited to, any substance listed in section 195.017; 50
66+ (3) A kratom product containing a level of 7 - 51
67+hydroxymitragynine in the alkaloid fraction that is greater 52
68+than two percent of the alkaloid composition of the product; 53

70+ (4) A kratom product containing any synthetic 54
71+alkaloids, including synthetic mitragynine, synthetic 7 - 55
72+hydroxymitragynine, or any other synthetically derived 56
73+compounds of the plant Mitragyna speciosa; or 57
74+ (5) A kratom product that does not include on its 58
75+package or label the amount of mitragynine and 7 - 59
76+hydroxymitragynine contained in the product. 60
77+ 6. A dealer shall not distribute, sell, or expose for 61
78+sale a kratom product to an individual under eighteen years 62
79+of age. 63
80+ 7. (1) If a dealer violates subdivision (1) of 64
81+subsection 4 of this section, the director may, after notice 65
82+and hearing, impose a fine on the dealer of no more than 66
83+five hundred dollars for the first offense and no more than 67
84+one thousand dollars for the second or sub sequent offense. 68
85+ (2) A dealer who violates subdivision (2) of 69
86+subsection 4 of this section, subsection 5 of this section, 70
87+or subsection 6 of this section is guilty of a class D 71
88+misdemeanor. 72
89+ (3) A person aggrieved by a violation of subdivisio n 73
90+(2) of subsection 4 of this section or subsection 5 of this 74
91+section may, in addition to and distinct from any other 75
92+remedy at law or in equity, bring a private cause of action 76
93+in a court of competent jurisdiction for damages resulting 77
94+from that violation including, but not limited to, economic, 78
95+noneconomic, and consequential damages. 79
96+ (4) A dealer does not violate subdivision (2) of 80
97+subsection 4 of this section or subsection 5 of this section 81
98+if a preponderance of the evidence shows that the dealer 82
99+relied in good faith upon the representations of a 83
100+manufacturer, processor, packer, or distributor of food 84
101+represented to be a kratom product. 85

103+ 8. The department shall promulgate rules to implement 86
104+the provisions of this section including, but not limited 87
105+to, the requirements for the format, size, and placement of 88
106+the disclosure label required pursuant to subdivision (1) of 89
107+subsection 4 of this section and for the information to be 90
108+included in the disclosure label. Any rule or portion o f a 91
109+rule, as that term is defined in section 536.010, that is 92
110+created under the authority delegated in this section shall 93
111+become effective only if it complies with and is subject to 94
112+all of the provisions of chapter 536 and, if applicable, 95
113+section 536.028. This section and chapter 536 are 96
114+nonseverable, and if any of the powers vested with the 97
115+general assembly pursuant to chapter 536 to review, to delay 98
116+the effective date, or to disapprove and annul a rule are 99
117+subsequently held unconstitutional, the n the grant of 100
118+rulemaking authority and any rule proposed or adopted after 101
119+August 28, 2022, shall be invalid and void. 102
