196.1170.1.Thissectionshallbeknownandmaybecitedasthe"Kratom
2ConsumerProtectionAct".
3 2.Asusedinthissection,thefollowingtermsmean:
4 (1)"Dealer",apersonwhosells,prepares,ormaintainskratomproductsor
5advertises,represents,orholdsoneselfoutasselling,preparing,ormaintainingkratom
6products.Suchpersonmayinclude,butnotbelimitedto,amanufacturer,wholesaler,
7store,restaurant,hotel,cateringfacility,camp,bakery,delicatessen,supermarket,
8grocerystore,conveniencestore,nursinghome,orfoodordrinkcompany;
9 (2)"Department",thedepartmentofhealthandseniorservices;
10 (3)"Director",thedirectorofthedepartmentorthedirector'sdesignee;
11 (4)"Food",afood,foodproduct,foodingredient,dietaryingredient,dietary
12supplement,orbeverageforhumanconsumption;
13 (5)"Kratomproduct",afoodproductordietaryingredientcontaininganypart
14oftheleafoftheplantMitragynaspeciosa.
15 3.Thegeneralassemblyherebyoccupiesandpreemptstheentirefieldof
16regulatingkratomproductstothecompleteexclusionofanyorder,ordinance,or
17regulationofanypoliticalsubdivisionofthisstate.Anypoliticalsubdivision'sexisting

20 4.(1)Adealerwhoprepares,distributes,sells,orexposesforsaleafoodthatis
21representedtobeakratomproductshalldiscloseontheproductlabelthefactualbasis
22uponwhichthatrepresentationismade.
23 (2)Adealershallnotprepare,distribute,sell,orexposeforsaleafood
24representedtobeakratomproductthatdoesnotconformtothedisclosurerequirement
25undersubdivision(1)ofthissubsection.
26 5.Adealershallnotprepare,distribute,sell,orexposeforsaleanyofthe
27following:
28 (1)Akratomproductthatisadulteratedwithadangerousnon-kratom
29substance.Akratomproductshallbeconsideredtobeadulteratedwithadangerous
30non-kratomsubstanceifthekratomproductismixedorpackedwithanon-kratom
31substanceandthatsubstanceaffectsthequalityorstrengthofthekratomproductto
32suchadegreeastorenderthekratomproductinjurioustoaconsumer;
33 (2)Akratomproductthatiscontaminatedwithadangerousnon-kratom
34substance.Akratomproductshallbeconsideredtobecontaminatedwithadangerous
35non-kratomsubstanceifthekratomproductcontainsapoisonousorotherwise
36deleteriousnon-kratomingredientincluding,butnotlimitedto,anysubstancelistedin
37section195.017;
38 (3)Akratomproductcontainingalevelof7-hydroxymitragynineinthealkaloid
39fractionthatisgreaterthantwopercentofthealkaloidcompositionoftheproduct;
40 (4)Akratomproductcontaininganysyntheticalkaloids,includingsynthetic
41mitragynine,synthetic7-hydroxymitragynine,oranyothersyntheticallyderived
42compoundsoftheplantMitragynaspeciosa;or
43 (5)Akratomproductthatdoesnotincludeonitspackageorlabeltheamountof
44mitragynineand7-hydroxymitragyninecontainedintheproduct.
45 6.Adealershallnotdistribute,sell,orexposeforsaleakratomproducttoan
46individualundereighteenyearsofage.
47 7.(1)Ifadealerviolatessubdivision(1)ofsubsection4ofthissection,the
48directormay,afternoticeandhearing,imposeafineonthedealerofnomorethanfive
49hundreddollarsforthefirstoffenseandnomorethanonethousanddollarsforthe
50secondorsubsequentoffense.
51 (2)Adealerwhoviolatessubdivision(2)ofsubsection4ofthissection,
52subsection5ofthissection,orsubsection6ofthissectionisguiltyofaclassD
53misdemeanor.

55sectionorsubsection5ofthissectionmay,inadditiontoanddistinctfromanyother
56remedyatlaworinequity,bringaprivatecauseofactioninacourtofcompetent
57jurisdictionfordamagesresultingfromthatviolationincluding,butnotlimitedto,
58economic,noneconomic,andconsequentialdamages.
59 (4)Adealerdoesnotviolatesubdivision(2)ofsubsection4ofthissectionor
60subsection5ofthissectionifapreponderanceoftheevidenceshowsthatthedealer
61reliedingoodfaithupontherepresentationsofamanufacturer,processor,packer,or
62distributoroffoodrepresentedtobeakratomproduct.
63 8.Thedepartmentshallpromulgaterulestoimplementtheprovisionsofthis
64sectionincluding,butnotlimitedto,therequirementsfortheformat,size,and
65placementofthedisclosurelabelrequiredpursuanttosubdivision(1)ofsubsection4of
66thissectionandfortheinformationtobeincludedinthedisclosurelabel.Anyruleor
67portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe
68authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
69subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This
70sectionandchapter536arenonseverable,andifanyofthepowersvestedwiththe
71generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
72disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
73rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2022,shallbe
74invalidandvoid.
